MEMORANDUM bF CONSIDERATION O F APPLICATION BEFORE THE AFBCMR
SUBJECT:
Having carefully reviewed this application, we agree with the
recommendation of the Air Force and adopt the rationale expressed
as the basis for our decision that the applicant has been the
victim of either an error or an injustice. Therefore, under the
authority delegated in A F I 36-2603, the applicant's records will
be corrected as set forth in the accompanying Memorandum for the
Chief of Staff signed by the Executive Director of the Board or
his designee.

SUBJECT: Application for Correction of Military Records
Requested Action and Basis for Request. Restore 5 days lost at FY97 year-end
balancing. Applicant returned from deployment in support of OPERATION SOUTHERN
WATCH and denied taking all use lose days before 1 Oct.
Facts and Discussion. Applicant had 60 days 1 Oct 96, used 25 days, and had 65 days on
30 Sep 97. He lost 5 days on 1 Oct 97 because under 10 USC 701(b) members cannot carry over
more than 60 days into the next FY. Applicant deployed in support of OPERATION
SOUTHERN WATCH on 10 Jul and returned on 3 Sep 97. He took 15 days leave 4 - 18 Sep 97.
According to commander’s statement, applicant was unable to use further leave due to manning
constraints. This resulted in the lost of 5 days on 1 Oct 97. In this case, we support granting
relief because applicant was unable to take these days due to military necessities.

Recommendation. Approve restoring 5 days to FY99 leave account.
