MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR
SUBJECT:
Having carefully reviewed this application, we agree with the
recommendation of the Air Force and adopt the rationale expressed
as the basis for our decision that the applicant has been the
victim of either an error or an injustice. Therefore, under the
authority delegated in AFI 36-2603, the applicant's records will
be corrected as set forth in the accompanying Memorandum for the
Chief of Staff signed by the Executive Director of the Board or
his designee.

SUBJECT: Application for Correction of Military Recor
Requested Action and Basis for Request. Restore 1 1.5 days leave lost at FY97 year-end.
Applicant states she lost these days due to unit operational requirements before starting formal
training that also precluded taking leave.
Facts. Applicant had 56.5 days on 1 Oct 96, earned 30 days, and used 15 days. She lost
11.5 days on 1 Oct 97 at FY97 year-end because 10 USC 701(b) precludes members from
carrying over more than 60 days into the next FY. (56.5 + 30 = 86.5 - 15 = 71.5 - 60 = 11.5)
Discussion. Supporting documents indicate applicant assigned to the Command Post of
the 7Ih Bomb Wing that supported numerous DoD operations, missions, and exercises. Further,
applicant had the opportunity to take only 15 days and was unable to take more leave due to the
number of operational mission requirements. She used 7 days, 23 - 29 Dec 96, and used 8 days,
- 5 Feb 97. Applicant departe

taking leave between 13 Mar and 1 Oct 97. Requiring members to complete a certain number of
training days to graduate is a universal training requirement. Consequently, members cannot
take leave while in formal training and must take use or lose leave before starting such training.
Although training requirements are not valid reasons to carry over more than 60 days into FY97,
we support granting relief. In this case, applicant lost leave because military necessities did not
allow her to take more leave before departing for formal retraining.
Recommendation. Approve restoring 1 1.5 days to current leave account.

Applicant states he lost leave because his residency program prevented him from taking normal leave. Therefore, he had 79 days on 1 Oct 96, used 13 days, and had 96 days as of 30 Sep 97. He requests reinstatement of lost leave based on AFBCMR’s rationale for restoring 19 days on 3 Jul97.
The AFPC disability office established a 10 Jan 97 separation date after authorizing 20 days processing time and 10 days PTDY and notified the Military Personnel Flight on 12 Dec 96. The leave history shows 5 days leave 16 - 20 Dec 96,20 days PTDY 21 Dec 96 - 9 Jan 97, and a negative leave balance of minus 11.5 days. FACTS: Applicant was involuntarily separated fiom the Air Force on 10 Jan 97 for physical disability under the provisions of AFI 36-3212.
