MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR
SUBJECT :
Having carefully reviewed this application, we agree with the
recommendation of the Air Staff and adopt the rationale expressed
as the basis for our decision that the applicant has been the
victim of either an error or an injustice. Therefore, under the
authority delegated in AFI 36-2603, the applicant's records will
be corrected as set forth in the accompanying Memorandum for the
Chief of Staff signed by the Executive Director of the Board or
his designee.

SUBJECT: Application for Correction of Military Records
Requested Action and Basis for Request. Restore 12 days lost at FY98 year-end
balancing. Applicant states mission requirements prevented him fiom using these days.
Facts and Discussion. Applicant had 60 days on 1 Oct 97, used 18 day, and had 72 days
on 30 Sep 98. He lost 12 days on 1 Oct 98 because under 10 USC 701 members cannot carry
more than 60 days into the next FY. The applicant states he lost 12 days because deployment to
fiom 2 Sep to 4 Oct 98 prevented him fiom using these days before 1 Oct.
Applicant's commander supports restoring lost leave since applicant was notified on or about 28
Aug 98 to deploy to - B W .
applicant was unable to take leave due to military requirements.

Restore 2 days charged leave for 25-26 Mar 98. When she reported in at the military personnel flight, finance allowed 3 days travel time 27 - 29 Mar 98 and charged 2 days leave, 25- 26 Mar 98. In this case, we support granting relief because the Air Force should not penalize the applicant for erroneous information received at the orderly room.

Applicant states he lost leave because his residency program prevented him from taking normal leave. Therefore, he had 79 days on 1 Oct 96, used 13 days, and had 96 days as of 30 Sep 97. He requests reinstatement of lost leave based on AFBCMR’s rationale for restoring 19 days on 3 Jul97.
Restore 8.5 days leave he will lose at FY98 year-end. Applicant had 39.5 days on 1 Oct 97, earned 30, used 1 day in FY98, and will have 68.5 days on 30 Sep 98. Applicant states he has been unable to use leave due to Undergraduate Pilot Training, Air Force Water Survival Training, and Pilot Instructor Training.
