MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR 
SUBJECT : 

Having carefully reviewed this application, we agree with 

the recommendation of the Air Force and adopt the rationale 
expressed as the basis for our decision that the applicant has 
been the victim of either an error or an injustice.  Therefore, 
under the authority delegated in AFI 36-2603, the applicant's 
records will be corrected as set forth in the accompanying 
Memorandum for the Chief of Staff signed by the Executive

SUBJECT: Application for Correction of Military Records - 

Requested Action and Basis for Request.  Restore 22 days lost at FY97 yearend 

balancing.  Applicant states he lost these days due to military requirements. 

Facts and Discussion.  Applicant had 58 days on 1 Oct 96, used 6 days, and had 82 days 

on 30 Sep 97.  He lost 22 days on 1 Oct 97 because 10 USC 701 prohibits members from 
carrying over more than 60 days into the next FY.  His commander supports this request because 
applicant was unable to use leave due to operational constraints. Applicant had planned to take 
leave in Sep in conjunction with overseas assignment. His overseas assignment, however, 
changed to a COWS assignment and his reporting date changed to a later date.  When he tried 
to take leave in Sep, the commander indicates leave denied due to military necessity.  In this 
case, we support granting relief. 

Recommendation.  Approve restoring 22 days to current leave account.
