APPLICANT REQUESTS THAT:

In two separate DD Form 149s:

The Duty Air Force Specialty Code (DAFSC) on his Officer  Performance
Report (OPR) rendered for the period 4 Jun 01 through 16  Sep  02  be
corrected to read 13S3E vice 13S3C.

The Letter of Reprimand (LOR) he received dated 27 Jun 02 be  removed
from his Officer Selection Record (OSR) and Officer Command Selection
Record Group (OCSRGp) early as authorized in Chief Staff of  the  Air
Force (CSAF) NOTAM 98-2.

He be considered for promotion to  the  grade  of  major  by  special
selection board (SSB) for  the  Calendar  Year  2005B  (CY05B)  Major
Central Selection Board (CSB).

APPLICANT CONTENDS THAT:

The OPR closing 16 Sep 02 with an incorrect Duty Title and DAFSC  was
in his OSR for the CY05B Major CSB.  It was brought to his  attention
by his counselor at HQ AFPC that erroneous duty  history  information
gave the false impression he was demoted in position when in fact  he
held the same position and was later promoted  to  flight  commander.
He contacted his military personnel flight (MPF) on 11 Apr 06 and his
duty history was  changed  in  the  Military  Personnel  Data  System
(MilPDS) based on his certification in the AFSC on 21 May 06.

After being considered for promotion  by  the  CY05B  Major  CSB,  he
appealed to have the LOR he received removed from his OSR and it  was
approved.  However, he subsequently learned that in  accordance  with
CSAF NOTAM 98-2, he could appeal to have the LOR removed from his OSR
early (prior to consideration for promotion).

In support of his appeal applicant provides a  statement  with  seven
attachments.

STATEMENT OF FACTS:

The applicant is presently serving on active duty  in  the  grade  of
captain.  On 27 Jun 02, the applicant received a Letter of Reprimand,
which his commander filed  in  his  Air  Force  and  Command  Officer
Selection Record.  A review of the  applicant’s  Officer  Performance
Reports (OPRs) on file, with the exception of the report  closing  16
Sep 02, reflect overall ratings of “Meets Standards.”  The  applicant
was marked as not  meeting  standards  in  the  area  of  “Leadership
Skills” on the OPR closing 16 Sep 02.  The applicant  was  considered
and not selected for promotion to the grade of  major  by  the  CY05B
Major Central Selection Board   (5 Dec 05).

AIR FORCE EVALUATION:

AFPC/DPAO addressed the applicant’s request to correct the  DAFSC  on
his OPR closing 16 Sep 02.  They recommend the applicant’s  DAFSC  be
corrected as requested.  They defer  on  his  request  for  promotion
consideration by SSB to AFPC/DPPPO.

AFPC/DPPPO recommends denial of the applicant’s  requests  to  remove
the LOR from his OSR early and for promotion consideration by SSB.

AFPC/DPPPO notes that AFPC/PBR1 removed the LOR from the  applicant’s
OSR on 19 Jun 06.  Although CSAF NOTAM 98-2 allows for early  removal
of  the  LOR,  the  applicant  did  not  provide  any   documentation
indicating his chain of command would have removed the LOR  prior  to
the convening date of the CY05B Major CSB.  AFPC/DPPPO contacted  the
applicant and advised him what documentation was required to  support
his request.  They state the applicant does not want to  pursue  this
request at this time.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant  on
11 Aug 06 for review and comment within 30 days.  To date, a response
has not been received.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented to  demonstrate
the existence of error or injustice.  After  reviewing  the  complete
evidence of record, we agree with the recommendations  of  AFPC/DPPPO
regarding the applicant’s request for early removal of the  LOR  date
27 Jun 02 from his Officer Selection Record, the  correction  of  the
DAFSC on his OPR closing 16 Sep 02 and his request to  be  considered
for promotion by Special Selection Board (SSB) for  the  CY05B  Major
Central Selection Board (CSB).  We note that DPPPO states  that  when
they contacted the applicant  to  advise  him  of  the  documentation
needed to pursue early removal of the LOR, he indicated  he  did  not
want to pursue this issue at this time.  Additionally, we  note  that
his OPR closing 16 Sep 02  has  been  administratively  corrected  to
indicate the correct DAFSC.  However, as pointed  out  by  DPPPO,  we
believe he failed to exercise due diligence to insure this correction
was made prior to the convening of the CY05B CSB.  The applicant  did
not provide a response to rebut  the  recommendations  and  rationale
provided by AFPC/DPPPO.  Therefore, we find no  basis  to  grant  the
relief requested in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
