APPLICANT REQUESTS THAT:

He be considered for promotion to the grade of lieutenant  colonel  by
Special Selection Board (SSB) for the Calendar Year  2006A  Lieutenant
Colonel  Central  Selection  Board  (CSB)  with  a  corrected  Officer
Selection Brief (OSB).

APPLICANT CONTENDS THAT:

During the CY06A Lieutenant Colonel promotion board,  his  record  was
missing his previous duty title.  The duty title  reflected  the  most
recent position held prior to becoming an IDE student.  In  accordance
with AFI 36-2501, para 6.3.2, he requests his records be submitted  at
the next Special Selection Board (SSB) based on this error.

In support of the appeal, applicant submits a copy of his SURF  and  a
copy of his latest Officer Performance Report (OPR).

STATEMENT OF FACTS:

The applicant is currently serving on  extended  active  duty  in  the
grade of major.

Applicant was considered and not selected for promotion to  the  grade
of  lieutenant  colonel  by  the  CY06A  Lieutenant  Colonel   Central
Selection Board (CSB).

Applicant’s Officer Performance Reports (OPRs) from 1993 through  2005
reflect meets standards on all performance factors.

AIR FORCE EVALUATION:

AFPC/DPAO recommends applicant’s duty history  be  corrected  to  show
that he was the Flight  Commander,  Current  Operations  in  the  23rd
Operational Support Squadron.   DPAO  defers  to  AFPC/DPPPO  for  SSB
consideration.

A complete copy of the evaluation is at Exhibit C.

AFPC/DPPPO  recommends  denial  of   applicant’s   request   for   SSB
consideration.  In reference to the applicant contending that the  OSB
was missing his duty title entry as  flight  commander,  DPPPO  states
that this error was discoverable and fixable if  the  applicant  would
have carefully reviewed his Officer Preselection Brief (OPB) prior  to
the board.  He should have taken the appropriate corrective action  as
directed in the OPB instructions, which are provided to each  eligible
officer prior to the convening of the CSB.

DPPPO notes AFI 36-2501, paragraph 6.3.3, states “Do not have  an  SSB
if, by  exercising  reasonable  diligence,  the  officer  should  have
discovered the error or  omission  and  could  have  taken  corrective
action before the originally scheduled board convened.”  The applicant
failed to exercise reasonable diligence in  ensuring  his  record  was
accurate prior to convening of the board.

DPPPO also notes,  although  his  OSB  reflected  the  incorrect  duty
history data, his respective officer performance report contained  the
correct information, which the board members reviewed  and  took  into
consideration in evaluating his record.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Applicant states a review was conducted and appropriate measures  were
taken to correct the errors detected.  Evidence can  be  seen  by  the
correction to the number of MSMs represented on the OSB that  met  the
board.  The assignment history  discrepancies  have  been  an  ongoing
battle.   Although  the  duty  title  error  does  not  introduce  new
information  to  the  record,  it  does  meet  the  criteria  for  SSB
consideration.  In a promotion board records counseling  session  with
Lt Col L--- M. T--- (AFPC/DPPPE) on  15 Aug 06, it was  assessed  that
this record was very close, if not the dividing line for promotions on
the CY06A board.  Lt Col T--- also stated that a record’s  error  such
as this could have been considered in a  tie-breaking  decision.   She
strongly advised pursuing an SSB because  they  exist  for  this  very
reason.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Sufficient relevant evidence has been presented  to  demonstrate
the existence of error  or  injustice.   The  majority  of  the  Board
believes that errors were made within the  applicant’s  duty  history.
While  it  cannot  be  conclusively  determined  whether  or  not  the
incorrect duty  history  was  the  reason  for  his  nonselection  for
promotion by the CY06A board, the majority of the Board believes  that
it  served  to  deprive  him  of  fair  and  equitable  consideration.
Therefore, the majority of the Board recommends his record, to include
an  OSB  reflecting  his  correct  duty  history,  be  considered  for
promotion by SSB for the CY06A lieutenant colonel board.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT, be corrected to show that the Officer Selection
Brief (OSB) prepared for the Calendar  Year  2006  (CY06A)  Lieutenant
Colonel Central  Selection  Board  (CSB)  be  amended  to  include  an
additional assignment history entry  of;  Effective  “11 March  2004,”
DAFSC “11F3B,” Duty  Title  “Flight  Commander,  Current  Operations,”
Command Level “W/B,” Major Command “ACC,” and Organization “Operations
Support Sq Pope.”

It is further recommended that the corrected record be considered  for
promotion to the grade of lieutenant colonel by  a  Special  Selection
Board for the Calendar Year  2006A  Lieutenant  Colonel  CSB  and  any
subsequent boards in which the above corrections were not a matter  of
record.

MEMORANDUM FOR THE CHIEF OF STAFF

           Having received and considered the recommendation of the
Air Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:

        The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that the Officer Selection
Brief (OSB) prepared for the Calendar Year 2006 (CY06A) Lieutenant Colonel
Central Selection Board (CSB) be amended to include an additional
assignment history entry of; Effective “11 March 2004,” DAFSC “11F3B,” Duty
Title “Flight Commander, Current Operations,” Command Level “W/B,” Major
Command “ACC,” and Organization “Operations Support Sq Pope.”

      It is further directed that the corrected record be considered for
