APPLICANT REQUESTS THAT:

She be  provided  Special  Selection  Board  (SSB)  consideration  for
promotion to the grade of major by the  Calendar  Year  2005B  (CY05B)
Major Central Selection Board (CSB), with  inclusion  of  her  missing
awards and decorations.

APPLICANT CONTENDS THAT:

The missing awards and decorations in question  were  updated  through
her servicing Military Personnel Flight (MPF) in Sep 05.  However, the
records did not reach the Air Force Personnel Center  (AFPC)  until  1
Dec 05.

There was pertinent information that was  misrepresented  and  totally
missing from her records that were considered by the CY05B CSB.

In support of her appeal, the applicant provided an expanded statement
and documentation pertaining to her decorations.

STATEMENT OF FACTS:

Information extracted from the Personnel Data System  (PDS)  indicates
the applicant is currently serving on active  duty  in  the  grade  of
captain, having been promoted to that grade on  7 Feb 01.   Her  Total
Active Federal Military Service Date (TAFMSD) is 8 Sep 1987.

AIR FORCE EVALUATION:

AFPC/DPPPO  recommends  denial  indicating  that   they   assume   the
misrepresented information the applicant is referring to is the  Board
Discrepancy  Report  filed  in  her  Officer  Selection  Record  (OSR)
indicating the Air Force Achievement Medal (AFAM) was not  updated  in
the Military Personnel Data System and that  the  Defense  Meritorious
Service Medal (DMSM) citation was missing from her OSR.  The applicant
provided a copy of the publishing orders, dated 19 Nov  99,  upgrading
her AFAM to the  Air  Force  Commendation  Medal  (AFCM)  and  of  the
publishing order, dated 16 Nov O5, amending  the  DMSM  to  the  Joint
Service Commendation Medal  (JSCM).   It  appears  the  applicant  was
actually  awarded  the  JSCM,  as  reflected  on  the   citation   and
certificate provided  by  the  applicant,  but  the  publishing  order
erroneously reflected the DMSM; therefore,  it  was  amended  to  read
JSCM.  Although  the  Board  Discrepancy  Report,  dated  17  Nov  05,
contained incorrect data, the board members were aware of the AFCM and
JSCM as evidenced by the accurate entries  on  her  Officer  Selection
Brief (OSB), dated 23 Nov 05, and were able to factor  them  into  the
promotion selection process.  The applicant states that in Sep 05  she
did a records review and immediately provided her MPF with the missing
documents; however, it is  unclear  which  record  she  verified.   To
ensure the contents of the actual OSR (a physical file) were accurate,
the applicant would have had to request a  copy  of  her  record  from
Officer Records at AFPC, or would have  had  to  contact  the  records
technician at this same office by telephone and gone over the contents
of her record, as directed in the instructions attached to the Officer
Preselection Brief (OPB) that  each  eligible  officer  for  promotion
receives prior to CSBs.  If she had done so, she  would  have  noticed
the missing citations and taken corrective action at that time.

According  to  AFPC/DPPPO,  the  applicant  does   not   provide   any
documentation supporting her attempts to check her  record  maintained
at AFPC.  It is the officer’s responsibility to ensure the accuracy of
her record at AFPC prior to the board convening date,  not  after  she
has been nonselected for promotion.  They have verified  that  all  of
her decoration citations are filed in her OSR.

In AFPC/DPPPO’s view, the applicant has not demonstrated she exercised
reasonable diligence in maintaining her  record.   Furthermore,  since
all of the applicant’s decorations were accurately  reflected  on  her
OSB, the board members were able to factor  them  into  the  promotion
selection process.  However,  should  the  Board  grant  relief,  they
recommend the JSCM, Joint Service Achievement Medal (JSAM) (Basic  and
First Oak Leaf Cluster (1OLC)),  Army  Commendation  Medal,  and  Army
Achievement Medal citations be filed in the applicant’s  OSR  for  the
CY05B Board.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Applicant reviewed  the  advisory  opinion  and  provided  a  detailed
response indicating, in part, that she has shown  that  she  exercised
more than reasonable diligence and tried more that once to correct her
records through her MPF.  Therefore, she requests that she be  granted
an SSB with inclusion of her missing awards and decorations.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to demonstrate the
existence  of  error  or  injustice.   After  reviewing  the  evidence
presented, we are persuaded that  the  applicant  may  not  have  been
fairly considered for promotion by the CY05B Major CSB because  of  an
inaccurate record.  In this respect, it appears the citations for  the
JSCM, JSAM,  JSAM  (1OLC),  Army  Commendation  Medal,  and  the  Army
Achievement Medal should have been in her OSR when she was  considered
for promotion to major.  It cannot  be  conclusively  determined  what
impact the omission of the citations may have had on  the  applicant’s
promotion opportunity.  However, we believe any  doubt  in  this  case
should be resolved in her favor, particularly since, in  our  opinion,
the applicant exercised reasonable diligence to ensure the accuracy of
her record.  Accordingly, we recommend that her record, to include her
corrected OSR reflecting the aforementioned citations,  be  considered
for promotion to the grade of major by an SSB for the CY05B Major CSB.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT, to include the citations for the Joint  Service
Commendation Medal (JSCM), Joint  Service  Achievement  Medal  (JSAM),
JSAM, First Oak Leaf Cluster (1OLC), Army Commendation Medal, and  the
Army Achievement Medal, be considered for promotion to  the  grade  of
major by a Special Selection Board for the Calendar Year 2005B (CY05B)
Major Central Selection Board.

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating to , to include the citations for the Joint Service
Commendation Medal (JSCM), Joint Service Achievement Medal (JSAM),
JSAM, First Oak Leaf Cluster (1OLC), Army Commendation Medal, and the
Army Achievement Medal, be considered for promotion to the grade of
major by a Special Selection Board for the Calendar Year 2005B (CY05B)
Major Central Selection Board.
