APPLICANT REQUESTS THAT:

1.  His Meritorious Service Medal (MSM) (1OLC) covering  the  period  14 Apr
00 through 5 Jun 02 be added to his Calendar Year 2002B  (CY02B)  Lieutenant
Colonel Officer Selection Record  (OSR)  and  added  to  his  CY02B  Officer
Selection Brief (OSB).

2.  His Joint Service Commendation Medal (JSCM) covering the period  30  May
00 through 26 Mar 02, be added to his CY02B OSR and OSB.

3.  Corrections be made to the Overseas Duty  History,  Academic  Education,
and Assignment History of the CY02B OSB.

4.  His corrected record be considered by a Special  Selection  Board  (SSB)
for promotion to the grade  of  lieutenant  colonel  by  the  CY02B  Central
Lieutenant Colonel Selection Board.

APPLICANT CONTENDS THAT:

Staff  and  coordination  issues  beyond  his  control   resulted   in   the
decorations  missing  from  his  selection  record.   Permanent  change   of
station,  staff,  and  administrative  coordination   issues   resulted   in
significant delays  to  coordination,  approval,  and  presentation  of  the
decorations.  He attempted on numerous occasions for more  than  a  year  to
update the Overseas Duty History on his  OSB.   Attempted  updates  to  this
information were entered incorrectly  to  reflect  13  continuous  years  in
Korea, and the deletion of a deployment to  Panama.   The  OSB  reflected  a
Master's Degree for Aero/Aviation Management when in fact the earned  degree
was for Space  Systems  Management.   Although  he  made  numerous  written,
telephone, and email requests, the  correct  academic  coding  updates  were
never  accomplished.   He  initiated  requests  for   corrections   to   his
assignment history in 2001 but  updates  through  PC-III  from  an  overseas
location proved impossible.  Numerous  requests  to  update  his  Assignment
History were not successfully implemented due  to  administrative  personnel
issues.

The impact of  the  missing  decorations  and  incorrect  duty  history  and
academic data were critical  items  and  key  discriminators  for  selection
board consideration.  The errors  prevented  selection  board  members  from
accurately assessing his  recent  performance,  career  accomplishments  and
demonstrated ability to perform in the next higher grade.

In support of his request, applicant provided  personal  statements,  copies
of  his  selection  briefs  and  data  verification  briefs,   his   Officer
Performance  Report  closing  5  May  02;  documentation   associated   with
assignment, education and duty history corrections; and copies  of  the  MSM
and JSCM citations.

STATEMENT OF FACTS:

Applicant was appointed a second lieutenant on  27  May  87.   He  has  been
progressively promoted to the grade of  lieutenant  colonel  having  assumed
that grade effective  and  with  a  date  of  rank  of  1 May  04.   He  was
considered and not  selected  for  promotion  to  the  grade  of  lieutenant
colonel by the CY02B selection board and was selected above-the-zone by  the
CY03A selection board.

AIR FORCE EVALUATION:

AFPC/DPAO defers a recommendation  to  DPPPO.   DPAO  states  the  requested
errors in the applicant's record have been  corrected  in  addition  to  two
additional errors.

The DPAO evaluation is at Exhibit C.

AFPC/DPPPO recommends the corrections made by DPAO be made to  his  OSB  but
denial of his  request  for  SSB  consideration.   DPPPO  states  the  JCSM,
awarded on 16 Jun 03  and  the  MSM  (1OLC)  awarded  on  12  Apr  04,  were
processed within the guidelines of AFI 36-2803.  These guidelines state  the
decorations recommendations are entered "into  official  channels  within  2
years and awarded  within  3  years  of  the  act  achievement,  or  service
performed."  In accordance with  published  guidance,  the  award  authority
announces its final decision when approving an award by  publishing  orders.
Since the orders for these decorations were published on 16 Jun  03  and  12
Apr 04, after the convening of the board, the citations could not have  been
filed in the OSR nor reflected in any personnel data system when  the  board
convened.  Thus, they did not exist when the board convened.  DPAO made  the
necessary corrections  to  the  applicant's  assignment  and  duty  history.
Because TDY duty history is not updated in duty  history  they  nonconcurred
with the start date for his  Undergraduate  Space  Training.   The  tour  in
Korea would not show on his CY02B OSB since this tour  was  completed  after
the board convened.

Each  officer  eligible  for  promotion  consideration  is  advised  of  the
entitlement to communicate with the board president  to  call  attention  to
any matter of record concerning them that they believe  important  to  their
consideration.  He did not elect to exercise this  entitlement.   The  DPPPO
evaluation is at Exhibit D.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

During his post-selection board counseling it  was  clearly  indicated  that
the missing medals were not only  a  significant  discriminator  during  the
selection board process but also a likely contributor to his  non-selection.
 The CSAF directed institutionalization of an  Air  Force-wide  standard  to
allow commanders to award decorations prior to a member's PCS.  The  delayed
decoration processing was administrative in nature as well  as  outside  his
ability to influence.  Not only did the decoration processing  delays  place
his OSR at a disadvantage it was also not consistent with the CSAF  directed
institutionalized standard.  The  period  of  accomplishment  cited  in  the
decorations is clearly prior to his PCS date  and  prior  to  the  selection
board convening date.

DPAO deleted two entries from his duty history "because TDY duty history  is
not updated  in  a  member's  duty  history."   According  to  Officer  Pre-
selection  Brief  (OPB)  instructions,   assignment   history   portrays   a
chronological listing of  duties  performed  for  60  days  or  longer.   An
Education/Training Report will cause a duty  history  entry  reflecting  the
duty for which the report was rendered. The original duty history  reflected
a 90-day operational deployment to Panama.  When he requested an  update  to
reflect his Korea tours, the Panama duty  history  entry  was  inadvertently
overwritten.  As this operational deployment duty and  his  formal  training
at the USAF Info Warfare Weapons School  exceeded  the  60-day  requirement,
they are appropriate assignment history entries.

Applicant contends that once  he  realized  the  corrections  would  not  be
completed in a  timely  manner,  he  considered  writing  a  letter  to  the
selection board president to highlight the discrepancies  in  his  selection
record.  However, since letters to  the  selection  board  require  original
signature and as he was assigned in Korea, it was not possible to provide  a
letter that met the original signature requirements in a timely  manner,  as
specified in the OPB

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence  of  error  or  injustice  warranting  corrective   action.    The
applicant requests numerous corrections be made to his OSR  as  it  met  the
CY02B  Lieutenant  Colonel  Selection  Board  and  that   he   receive   SSB
consideration for promotion by that board.  We note that the Air  Force  has
concurred with the portion of  his  requests  regarding  correction  to  his
academic education and has made corrections to his duty  history.   However,
corrections made by the Air Force to his duty history include removal  of  a
deployment to Panama and a  temporary  duty  assignment  to  the  USAF  Info
Warfare Weapons School.  Applicant does not agree with the  removal  of  his
temporary duties citing guidance  contained  in  the  Officer  Pre-selection
Brief (OPB) Instructions.  After reviewing the evidence of  record  and  the
applicant's submissions, we believe that his OSB should be corrected to  the
extent of allowing inclusion of his deployment to  Panama.   We  arrived  at
this decision based upon the fact that  current  OPB  guidance  states  that
deployments are not included in the Assignment History section of  the  OSB.
However, guidance prepared at the time of the November 2002  board  did  not
reflect that exclusion.  Therefore, it is our  opinion  that  the  applicant
has established reasonable doubt as to whether or not that assignment  entry
should remain and we believe in this instance,  the  benefit  of  the  doubt
should be resolved in his favor.   Since  temporary  assignments  to  formal
schools are not reflected in the Assignment History section  we  agree  with
the Air Force's determination that his  temporary  duty  at  the  USAF  Info
Warfare Weapons School should not be included.  Therefore, we recommend  his
records be corrected to the extent indicated below.

4.  In addition to the above, applicant requests his MSM (1OLC) and JCSM  be
included  in  the  selection  process.   His   contentions   regarding   the
timeliness and impact of the medals on  his  nonselection  are  duly  noted;
however, we are inclined to agree with the Air Force that the processing  of
the medals was timely, in accordance with applicable instruction, and it  is
our opinion that inclusion of the  medals  in  his  CY02B  selection  record
would  provide  him  with  an  unfair  advantage  over  similarly   situated
individuals.  Therefore, we do not believe that favorable  consideration  of
that portion of his request is warranted.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT be corrected to show that his  Officer  Selection  Brief  (OSB)
prepared for  the  CY02B  Central  Lieutenant  Colonel  Selection  Board  be
corrected as follows:

a.  The 2002 entry in the Academic Education Specialty/School Section be
corrected to reflect "SPACE SYSTEMS MGT" rather than " BUS ADM. AERO/AVIA
MGT."

b.  The Assignment History Section be amended to reflect:  Effective 22
March 1989, DAFSC "8124," Duty Title "Executive Officer," Command Level
"W/B," Major Command "OT," and Organization "Space Support Group, Panama."

c.  The Overseas Duty History Section be corrected to show "KORES, 02 April
2001 through 07 June 2002," vice "KORES 02 April 2001 through 01 April
2002,"; and, delete the entry "KORES 22 March 1989 through 07 April 2000."


It is further recommended that his record, to include  the  above  corrected
OSB, be considered for promotion to the grade of  lieutenant  colonel  by  a
Special Selection Board for  the  Calendar  Year  2002B  Central  Lieutenant
Colonel Selection Board.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that his Officer Selection
Brief (OSB) prepared for the Calendar Year 2002B Central Lieutenant Colonel
Selection Board be corrected as follows:

            a.  The 2002 entry in the Academic Education Specialty/School
Section be corrected to reflect "SPACE SYSTEMS MGT" rather than " BUS ADM.
AERO/AVIA MGT."

            b.  The Assignment History Section be amended to reflect:
Effective 22 March 1989, DAFSC "8124," Duty Title "Executive Officer,"
Command Level "W/B," Major Command "OT," and Organization "Space Support
Group, Panama."

            c.  The Overseas Duty History Section be corrected to show
