APPLICANT REQUESTS THAT:
He be considered for promotion by a Special Selection Board (SSB)
for the CY05A (6 Jul 05) (P0505A) Lieutenant Colonel Central
Selection Board.

APPLICANT CONTENDS THAT:
Prior to meeting the CY05B Lt Col Line board, he corrected his duty
title with his orderly room. They assured him the correction was
in the system, however, unfortunately, due to computer problems,
the correction did not take place. His duty title was also
incorrect on his promotion recommendation form (PRF).
He was deployed at the time of the promotion announcement and did
not have access to the AFPC website. When he returned home, he
learned that the duty title had not been updated.
He believes this materially damaged his promotion prospects at the
CY05B promotion board because his duty history failed to show
proper progression.
In support of his appeal, applicant submitted a personal statement;
a copy of his PRF for the P0504B promotion board, and computer
printouts of his current duty title and duty history.

STATEMENT OF FACTS:
The applicant is currently serving in the grade of major, with an
effective date and date of rank of 1 Jul 01, with a Duty Title of
Assistant Chief of Flight Safety/C-130H Instructor Pilot.
Applicant was nonselected for promotion by the CY05A (6 Jul 05),
Lieutenant Colonel Central Selection Board (CSB).

AIR FORCE EVALUATION:
HQ AFPC/DPAO recommended the applicant’s duty title and his Duty
Air Force Specialty Code (DAFSC) be corrected on his PRF.
Applicant’s duty title on his officer selection brief (OSB) should
be replaced with “Asst Chf of Flt Safety/C-130H IP” effective 1 Jun
04. This was substantiated by the officer performance report (OPR)
with a 31 May 05 closeout date. His DAFSC on his PRF should be
K11M3B.
They deferred to HQ AFPC/DPPPO for Special Selection Board (SSB)
consideration.
Additionally, DPAO states that the actual board the applicant is
contesting is the P0505A Board (Primary).
The HQ AFPC/DPAO complete evaluation, with attachments, is at
Exhibit C.
HQ AFPC/DPPPE recommended denial. They state applicant indicated
prior to meeting the CY05A Lt Col promotion board, he contacted his
orderly room to correct his duty title. The orderly room provided
a memo stating the applicant initiated corrective action on or
about 25 May 05 and that MILPDS was updated correctly, however, AMS
did not read the update. DPPPE reviewed the update in MILPDS and
noticed the update in MILPDS was not updated until 9 Nov 05. The
AMS system is a direct reflection of MILPDS and if it contained
wrong information, then the reason for it is because MILPDS
contained wrong information.
Further, the applicant states that he was deployed at the time of
the promotion release. During his return he noticed the duty title
was not updated. Officers are encouraged to ensure their records
are accurate prior to meeting the CSB. The applicant failed to
review his records prior to the CSB of 6 Jul 05. The applicant had
from 26 May 05 – 6 Jul 05 to review his records and ensure the duty
title was updated correctly. In addition, the applicant did not
depart for his temporary duty (TDY) until 25 Aug 05. The TDY
played no part in his process to correct his records prior to the
CSB.
Additionally, the applicant states the PRF reflects the incorrect
duty title. After review of the PRF, DPPPE determined the PRF is
accurate. Senior Raters (SRs) are authorized to use the
information (i.e., duty title) from the last OPR on file to
complete the PRF. The last report on file during the PRF process
was the 31 May 04 OPR; which reflects a duty title of “Chief of
Readiness/C-130H Instructor Aircraft Commander.” The earliest the
SR could sign the PRF was on 6 May 05. As of 6 May 05, the duty
title on the P0505A PRF was accurately documented per the 31 May 04
OPR.
Although the duty title “Assistant Chief of Flight Safety/C-130H
Instructor Pilot” was not correctly reflected on his OSB, it was
correct on his 31 May 05 OPR and therefore available to the board
members for their consideration in the promotion selection process.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Copies of the Air Force evaluations were forwarded to the applicant
on 12 May 06 for review and comment within 30 days. As of this
date, no response has been received by this office (Exhibit E).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice warranting a
correction of his OSB/PRF, and SSB consideration. The applicant
contends his nonselection for promotion to lieutenant colonel by
the CY05A Lieutenant Colonel Central Selection Board was due to an
incorrect duty title on his OSB and PRF, which materially damaged
his prospects for promotion because it failed to show proper
progression. The Board noted the recommendation by the Deputy
Chief, Operations Assignment Division; however, we disagree. While
the duty title “Assistant Chief of Flight Safety/C-130H Instructor
Pilot” was not reflected on his OSB, it was correct on his 31 May
05 OPR and available to the CSB and the duty title reflected on the
PRF was accurate at the time his Senior Rater signed the PRF. The
Chief, Evaluations Programs Branch, recommends the applicant’s
request be denied. The applicant contends he was deployed at the
time of the promotion release and did not notice the duty title
error until he returned. DPPPE noted that officers are encouraged
to ensure their records are accurate prior to meeting the CSB.
Evidence reflects the applicant did not depart for his TDY until
25 Aug 05 and had ample time to correct his duty title on the
officer preselection brief (OPB), as well as the PRF prior to 6 Jul
05. Therefore, we agree with the opinions and recommendations of
AFPC/DPPPE and adopt its rationale as the basis for our decision
that the applicant has failed to sustain his burden of having
suffered either an error or injustice. Hence, in the absence of
persuasive evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
