APPLICANT REQUESTS THAT:

His Officer Selection Brief (OSB) be correct to reflect:

    a.  Correct flying hours in Aeronautical/Flying Data section.

            b.    Correct Joint Duty  Assignment  in  the  Joint  Duty
History section.

            c.    Correct Duty Air Force Specialty Code (DAFSC)

            d.    Correct Duty title for his duty assignment effective
10 July 2005.

            e.    Inclusion of his Officer  Performance  Report  (OPR)
closing 27 January 2006 in his Officer Selection Record (OSR) for  the
calendar year (CY) 2006A Lieutenant Colonel  Central  Selection  Board
(CSB) and he receive Special Selection Board  (SSB)  consideration  by
the same board.

APPLICANT CONTENDS THAT:

The errors in his OSB prevented the board from  reviewing  a  complete
record and rendering a proper score.

In support of his appeal the applicant submitted a copy of his OSB,  E-
mails, OPR, and the selection board schedule.

Applicant's complete submission,  with  attachments,  is  attached  at
Exhibit A.

STATEMENT OF FACTS:

Applicant is currently serving on active duty in the grade of major.

Applicant was considered but not selected for promotion to  the  grade
of lieutenant colonel by the CY04B, CY05A and CY06A lieutenant colonel
CSBs.

Applicant’s OPR profile as a major is listed below.

AIR FORCE EVALUATION:

HQ AFPC/DPAO recommends granting partial  relief  on  the  applicant’s
request for correction  of  military  records.   AFPC/DPAO  recommends
correcting the applicant’s record to  reflect  the  appropriate  DAFSC
(124MT) and duty title (Chief,  Air-to-Air  Refueling  (AAR)  Plans.”.
They state the DAFSC for the applicant’s assigned position  is  12M4T.
His duty title from the OPR which closed out on 27  January  2006  was
Chief, AAR Plans.  They further state the  applicant  held  a  reserve
commission at the time of  the  lieutenant  colonel  selection  board.
Prior to 1 May 2006, the Joint  Officer  Management  (JOM)  could  not
update joint tours on officers who did not hold a  Regular  Air  Force
(RegAF) date.   On  1  May  2006,  the  RegAF  date  prerequisite  was
eliminated, and the JOM was able  to  update  all  joint  tours.   The
applicant’s record was updated to reflect his joint tour in May  2006.
However, all records including his OSB prior to 1 May  2006  will  not
reflect joint duty, nor should it be changed retroactively.

AFPC DPAO’s evaluation, with attachments, is attached at Exhibit C.

HQ AFPC/DPPPO recommends granting partial relief  on  the  applicant’s
request for correction of military records.  AFPC/DPPPO recommends the
applicant’s OSB be corrected to reflect the appropriate  flying  hours
provided  by  the  Host  Aircrew  Rated  Management   System   (HARMS)
Superintendent and grant him SSB  consideration  by  the  P0506A  CSB.
They state the applicant’s OPB showed the applicant  has  a  total  of
3,232 flying hours, but his  OSB  only  reflected  727  flying  hours.
HARMS maintains servicemembers flying records and verifies the type of
aircraft flown and his total flying hours (3,155).

They further recommend  denying  relief  regarding  SSB  consideration
based on the applicant’s joint duty assignment.  They further state if
the Board approves correcting  the  applicant’s  OSB  to  include  the
flying data and  grants  an  SSB  consideration,  they  recommend  his
assignment history be corrected as well.

Lastly, the applicant’s contention  that  his  most  current  OPR  was
missing from his OSR.  Officers considered by  promotion  boards  have
different closeout dates for performance reports.  The AFI states that
OPRs on EAD officers are  due  at  HQ  AFPC  no  later  than  60  days
following closeout of the report.  The applicant’s performance  report
closed out on 27 January 2006 and was not required to be on file until
26  March  2006.   Many  board  eligible  officers  fall   into   this
predicament, approving SSB consideration with a report not required to
be on file would generate unfairness in the current promotion process.

Furthermore, eligible officers meeting a  board  have  the  option  to
submit a letter to the board president addressing any matter of record
concerning  themselves  that  they  believe  is  important  to   their
consideration for  promotion.   As  such,  the  applicant  could  have
written  a  letter  to  the  board  members  informing  them  of   the
accomplishments mention in his report.  We have verified that  he  did
not elect to exercise this option.  They further  state  the  time  to
submit a letter to the board is prior to the convening of the original
board, not after his nonselection for promotion.

APPLICANT'S REVIEW OF AIR STAFF EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant on
26 January 2007, for  review  and  response.   As  of  this  date,  no
response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of  an  error  or  an  injustice  with  respect  to  the
applicant’s request to have his joint duty  history  included  on  his
Officer Selection Brief (OSB). After reviewing the evidence presented,
the Board agrees with the opinion and  recommendation  of  the  Deputy
Chief, Operations Assisgnments Division, and adopts his  rationals  as
the basis for denial the applicant’s above request.

4. Notwithstanding the above, sufficient relevant  evidence  has  been
presented to demonstrate the existence of an  error  or  an  injustice
that warrants relief.  After reviewing  the  complete  case  file,  we
noted that the applicant’s OSB did  not  reflect  his  correct  flying
hours,  DAFSC,  and  duty  title.   Whether   this   information   was
sufficiently significant to alter the results of the CY06A  Lieutenant
Colonel Central Selection Board is a question we are unable to  answer
on the basis of the evidence presented here.  In view of the foregoing
and in an effort to remove any possibility  of  an  injustice  to  the
applicant, we recommend that his  record  be  corrected  as  indicated
below.  With respect to the applicant’s request  regarding  his  joint
duty history, the Board concurs with the opinion and recommendation of
AFPC/DPAO.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department  of  the  Air  Force
relating to APPLICANT, be corrected to show that:

      a.    The 7 March 2006, Officer Selection Brief be corrected to
reflect his duty title  and  DAFSC  as  Chief,  Air-to-Air  Refueling
Plans, “124MT with an effective date of 10 July 2005.

      b.    The  Aeronautical/Flying  data  section  on  his  OSB  be
corrected to  reflect  the  flying  hours  maintained  by  the  HARMS
Superintendent.

      c.    The Officer Performance Report for the period 28  January
2005 through 27 January 2006, was accepted for file  in  his  Officer
Selection Record (OSR) on or before 12 March 2006.

      d.    It is further  recommended  that  he  be  considered  for
promotion to the grade of lieutenant colonel by a  Special  Selection
Board for the calendar year 2006A Lieutenant Colonel Selection Board.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having reviewed and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116) it is directed that:

      The pertinent military records of the Department of the Air Force
relating to           , be corrected to show that:

      a.    The 7 March 2006, Officer Selection Brief be corrected to
reflect his duty title and DAFSC as “124MT, Chief, Air-to-Air
Refueling Plans with an effective date of 10 July 2005.

      b.    The Aeronautical/Flying data section on his OPB be
corrected to reflect the flying hours maintained by the HARMS
Superintendent.

      c.    The Officer Performance Report for the period 28 January
2005 through 27 January 2006 was accepted for file in his Officer
Selection Record (OSR) on or before 12 March 2006.

      It is further directed that the corrected record be considered for
promotion to the grade of lieutenant colonel by Special Selection Board for
the CY06A Lieutenant Colonel Selection Board.
