MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR 

SUBJECT: 

Having carefully reviewed this application, we agree with the 

recommendation of the Air Staff and adopt the rationale expressed as 
the basis for our decision that the applicant has been the victim of 
either an error or an injustice. 
delegated in AFI 36-2603, the applicant's records will be corrected as 
set forth in the accompanying Memorandum for the Chief of Staff signed 
by the Executive Director of the Board or his designee.

SUBJECT:  Application for Correction of Military Record4 

Requested Actio~l and Basis for Request.  Restore 5 days lost at FY98 year-end 
balancing. Applicant states mission requirements prevented him from using these days. 

Facts and Discussion.  On 6 Jul98, the AFBCMR approved restoring 5 days and finance 

corrected the leave balance in the end-of-the-month July 98 leave and earning statement. 
Applicant states that mission requirements and duties as acting commander prevented him from 
using leave during Aug and Sep 98.  He had 68 days on 30 Sep 98 and lost 8 days on 1 Oct 98 
because under 10 USC 701 members cannot carry over more than 60 days into the next FY.  In 
this case, we support granting relief because military necessities precluded applicant from taking 
leave during Aug and Sep 98. 

Recommendation.  Approve restoring 8 days to FY99 leave account.
