Under the authority of Section 1 5 5 2 ,   Title 10, United States 

Code, and Air Force Instruction 3 6 - 2 6 0 3 ,   and having assured 
compliance with the provisions of the above regulation, the 
decision of the Air Force Board for Correction of Military 
Records is announced, and it is directed that:

MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR

Having carefully reviewed this application, we agree with 

the recommendation of the Air Force office of primary 
responsibility and adopt the rationale expressed as the basis for 
our decision that the applicant has been the victim of either an 
error or an injustice.  Therefore, under the authority delegated 
in AFI 36-2603, the applicant's records will be corrected as set 
forth in the accompanying Memorandum for the Chief of Staff 
signed by the Executive Director of the Board or his designee.

Requested Action and Basis for Request.  Restore 28 days lost at FY97-end balancing. 
Applicant states finance personnel told her she would not lose these days if she started leave 
before 1 Oct. 

Factsmd Discussion. Applicant had 88 days on 30 Sep 97.  She states finance personnel 

told her she would not lose any days since the base was closing and she was

starting terminal leave on 1 Oct.  This, of course, is incorrect.  Applicant lost 28 days on 1 Oct 97 
because 10 USC 70 1 prohibits members fiom carrying over more than 60 days into the next FY. 
Applicant took terminal leave 1 Oct - 29 Nov 97 and received payment for 5 days of accrued 
leave.  She separated fiom the Air Force on 29 Nov 97.  In this case, we support granting relief 
because applicant trusted the appropriate agents of the government, resulting in lost days of 
leave. 

Recommendation.  Approve restoring 28 days to w e n t  leave account.  Applicant is due 

payment for these 28 days of accrued leave.

After reviewing your application for correction of records dated 2 Jan 98, we need 

additional information.  Please provide statements fiom base finance personnel who stated you 
would not lose 28 days on 1 Oct if you started terminal leave on that date.  The leave and 
earning statement shows the useAose days members must take by 30 Sep.  By operation of 
.law, members lose all accrued leave in excess of 60 days on 1 Oct because they cannot carry 
over more than 60 days into the next FY. 

Please do not interpret this memorandum as denial of your application.  You have 60 

days fiom the date of this memorandum to reply to the above address.  We will send your 
application to the AFBCMR with or without the additional documentation after that time.
