MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR 
SUBJECT : 

Having carefully reviewed this application, we agree with the 
recommendation of the Air Force office of primary responsibility 
and adopt the rationale expressed as the basis for our decision 
that the applicant has been the victim of either an error or an 
injustice.  Therefore, under the authority delegated in AFI 
36-2603, the applicant's records will be corrected as set forth in 
the accompanying Memorandum for the Chief of Staff signed by the 
Executive Director of the Board or his designee.

Correction of Military Records 

Requested Action and Basis for Request.  Restore 5 days lost at FY96 year-end 

balancing.  Applicant states he lost these days due to military requirements. 

Facts and Discussion.  Applicant had 60 days on 1 Oct 95 used 25 days, and had 65 days 

at the end of FY96.  He lost 5 days on 1 Oct 96 because 10 USC 701 prohibits members from 
carrying over more than 60 days into the next FY.  Applicant deployed in support of an 
operational mission Oct - Dec 95.  After t4e deployment, he was responsible for leading his 
squadron through a MAJCOM operational readiness inspection followed by taking command of 
another squadron undergoing a dramatic mission change.  Applicant lost 5 days of leave at the 
end of FY96 due to these operational unit requirements.  His commander supports reinstating the 
5 days of lost leave.  In this case, we support granting relief since applicant was unable to take 
use or lose days of leave due to military necessity. 

Recommendation.  Approve restoring 5 days to current leave account.
