Having carefully reviewed this. application, -.we agree with the.
recommendation of the Air Force’ and adopt the rationale expressed
as the basis for our decision that the applicant thas been the
victim of either an error or an injustice. Therefore, under the

SUBJECT: Application for Correction of Military Records _

Requested Action and Basis for Request. Restore 11.5 days leave lost at FY97 year-énd,
Applicant states she lost these days due to unit operational requirements before starting formal --
training that also precluded taking leave. _ .

Facts. Applicant had.56.5 days on-1 Oct 96, earned 30 days, and used 15 days.’ She lost
11.5 days on:1 Oct 97 at FY97 year-end because 10 USC 701(b) precludes members from
carrying over more than 60 days into the next FY. (56.5 +30 = 86.5 - 15 = 71.5.- 60-=11.5)

 

Discussion. Supporting documents indicate applicant assigned to the Command Post of
the 7" Bomb Wing that supported numerous DoD operations, missions, and exercises. :Further,
applicant had the opportunity to take only'15 days and was unable to take more leave due to the -
number of operational mission requirements. She used 7 days, 23 -.29 Dec 96, and used:8'days,
' 29 Jan- 5 Feb 97. Applicant departed Dyess AFB TX to attend retraining at Goodfellow AFB’
TX. She states course requirements for retraining as.an intelligence officer precluded her from
taking leave between 13 Mar and 1 Oct 97. Requiring members to complete a certain number of
training days to graduate is a universal training requirement. Consequently, members canriot
take leave while in formal training and must take use or lose leave before starting such training.
Although training requirements are not valid reasons to carry over more than 60 days into FY97,
we support granting relief. In this case, applicant lost leave:becausé. military necessities did not |,

allow her to take more leavé before departing for formal retraining.
