I'ursirant  to  the  provisions  of  reference  (a), Sihject  hereinafter  referred  to  as  Petitioner, 
filed enclosure ( I )   wit11 this  Board  requesting,  in  effect, that  tlie applicable naval  record  be 
corrected  to  show  he  reenlisted  and  was  atlvancetl undor  the  provisions  of  the  Selective 
Training  and  Reenlistment  (STAR) program.. 

2.  The  Board,  consisting  of  Mr.  McPartlin,  Mr.  Milner,  and  Ms.  Hare,  reviewed 
Petitioner's  allegations of  error  and  i~~~jilstice 
regulations,  determined  that  tlie corrective  action  indicated  below  should  be  taken  011  the 
available evidence  of  record.  Documentary  material  considered  by  the  Board  consisted  of  the 
enclosures,  naval  records,  and  applicable statutes,  regulations  and  policies.

3.  The Board,  having  reviewed  all  tlie  facts of  record  pertaining  to  Petitioner's  allegations 
of  error and  il~justice, finds as follows: 

a.  Before  applying to  this  Board,  Petitioner  exhausted  all  administrative remedim 

available  under  existing  law and  regulations  within  the  Departnient  of  the  Navy. 

b. 

In  correspondence  attached  as enclosure  (2), the office having  cognizance over  the 

subject  n~atter addressed  in  Petitioner's application  lias conimented  to  the effect  that  the 
request  lias  merit  and  warrants  favorable action. 

CONCLUSION 

Upon  review  and  consideration of  all  the evidence of  record,  arid  especially  in  light of  the 
contents of  enclosure (2), tlie  Board  finds the  existence of  an  i~ljustice warranting  the 
following corrective action.

RECOMMENDATION: 

That  Petitioner's naval  record  be  corrected,  where  appropriate,  to  show  that 

a.  He  was  tliscliargedlreenlistetl on  3 1  January11  February  2000,  under  the  provisions 
of  the  STAR  program,  vice  on  or about  24/25  February  2000.  The  term  is 4  years,  vice 5 
years. 

b.  He  uras ailtomatically  advanced  to  paygrade  E5  effective  1  February  2000. 

c .   That  a  copy  of  this  Relwrt  of  l'roceedings  be  filed  in  Petitioner's  naval  record.
