GENERAL : The applicant appeals for upgrade of discharge to Honorable. The applicant was offered a personal appearance before the Discharge Review Board (ORB) but declined and requests that the review be completed based on the available service record. The attached brief contains available perti nent data on the applicant and the factors leading to the discharge. FINDING: The Board denies the upgrade of the discharge. ISSUE: The appl icant recei ved a General d ischarge for Misconduct - Minor Disciplina ry Infractions
The Air Force Discharge Review Board, under its responsi bil i ty to examine the propriety and equity of an applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. In reviewing discharges, the Board presumes regulari ty in the conduct of governmenta l affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The applicant's record of service included one Article 15, two Letters of Reprimand and four Records of Counsel ing. His misconduct included failure to go to place of duty (2x), dereliction of duties (2x), failure to go to mandatory squadron PT, consuming alcohol under the age of 21, wrongfull y proffering a fraudulent military identification card, and failure to obey lawful order by remai ning in residence while on quarters.
The appl icant submitted no issues regard ing the ineq ui ty or impropriety of his discharge. The applicant does submit that an upgrade would allow him to obtain better job opportuni ties. The Board opined that through the administrat ive actions taken, the applicant had ample opportuni t ies to change his negati ve behavior. They found the seriousness of the willful misconduct offset any posi t ive aspects of the applicant's duty performance. The Board reviewed the entire record and found no evidence of impropriety or inequity to warrant an upgrade of the discharge. A discharge is upgraded only i f the appl icant and the Board can establish that an inequ ity or impropriety took place at the time of discharge. After a thorough review of the record, the Board found no evidence to justify an upgrade of the discharge characterization, reason for the discharge or the reenlistment code.
CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substanti ve requi rements of the discharge regulation, was withi n the discretion of the discharge authority, and that the applicant was provided full administrati ve due process.
In view of the foregoing find ings. the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determi nes the discharge should remain unchanged. Attach ment: Exami ner's Brief |
