GENERAL: The applicant appeals for upgrade of discharge to I lonorable.
The applicant was offered a personal appearance before the Discharge Review Board (ORB) but declined and requests that the review be completed based on the avai lable service record. The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. FIN DING : The Board denies the upgrade of the d ischarge.

The Air Force Discha rge Review Board, under i ts responsi bil i ty to examine t he propriety and equity of an Applicant's discharge, is authorized to change the characterizat ion of service and the reason for discharge if such change is watTa ntcd. I n reviewing discharges, the Board presumes regulari ty in the conduct of governmental affa i rs unless there is substantia l cred ible evidence to rebut the presumption. to incl ude evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the perti nent standards of equity and propriety. The applicant' s record of service incl uded three Letters of Repri mand, two Letters of Counseling and three Records of Counsel ing. His misconduct incl uded misuse of Government Travel Card, missi ng uni t recall fou r t imes, derelict ion of duty. damage to government property and failure to mai ntain l iving quarters wi thin standards, missi ng 58\V PA setup. depart ing duty location without authority. failure to be clean shaven and within uni form standards. and failure to assist an inspector as requested.
The appl icant submitted no issues regardi ng the inequi ty or im propriety of his discharge. The applicant docs submit that he would like an upgrade to increase his job opportuni ties and to create a better life for his fami l y. The Board opined that through the admin istrat i ve actions taken, the applicant had ample oppo1tu nit ics to change his behavior. They found the seriousness or the wi l l ful miscond uct offset any pos i t ive aspects of the appl icant's duty performance. The Board reviewed t he entire record and found no evidence or i mpropriet y or i nequ i ty to warrant an upgrade of the d ischarge. A discharge is upgraded only i f the appl ican t and the Board can establ ish that an ineq ui ty or im propriety took place at the time of discharge. After a thorough review of the record, the Board found no evidence to just ify an upgrade of the discharge.
CONCLUS ION : The Discharge Review Boa rd concludes that the discharge was consistent with the proced ural and substant ive req uirements of the discharge regulat ion, was withi n the discretion of the discharge authorit y, and that the applicant was pro\·idcd fu ll administ rat ive due process.
I n \'icw of the foregoing find ings. the Board fu1ther concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should rema i n u nchanged. Attachment: Examiner's Brief |
