GENERAL: The applicant appeals for upgrade of discharge to honorable

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the appl icant and the factors lead ing to the discharge.

FINDI NG: The Board denies the upgrade of the discharge

ISSUE: Applicant received a General discharge for Misconduct - Minor Disciplinary Infractions

The Air Force Discharge Review Board , under i ts responsibili ty to examine the propriety and equity of an applicanf s discharge, i s authorized to change the character of service and the reason for discharge if such change is wa1nnted. ln reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption , to include evidence submitted by the applicant. The Board did com plete a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The Applicant's record of service included two Records of Counsel, three Letters of Repri mand , and one A1ticle
15. His misconduct incl uded two failures to go on time, failure of dorm room inspection , reckless driving, fai lure to make an effort to have driver of GOY slow down to the legal speed l imit and driving while under the influence of alcohol.

The appl icant submitted no issues regarding inequi ty or im propriety of his discharge; howev er applicant contends that he shou ld not be penal ized indefinitel y for mistakes made when he was you ng. The DRB recognized the appl icant was 22 yea rs of age when the discharge took place. The Board opined the applican t was older than the vast majori ty of first-tem1 members who properl y adhere to the Air Force's standards of cond uct. The ORB concluded that the characteri zation of the applicant's d ischarge was appropriate due to the misconduct. The Board concluded that the negati ve aspects of the applicanf s service outweighed the positi ve contributions he made in his Air Force career.

A discharge is upgraded only if the applicant and the Board can establish that an inequity or impropriety took place at the time of discharge. After a thorough review of the record , the Board found no evidence to just ify an upgrade of the discharge characte1ization, reason for the discharge or the reenlistment code.

CONCLUS ION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substan tive requirements of the discharge regu lation and was within the discret ion of the discharge authority and the applicant was provided full administrati ve due process.

In view of the foregoing findings, the Board fu1ther concludes that there exists no legal or equ i table basis for upgrade of discharge and determines the discharge should remain unchanged.
