GEN ERAL: The applicant appeals for upgrade of discharge to Honorable.

The applicant was offered a personal appearance before the Discharge Review Board (ORB) but declined and requests that the review be completed based on the avai lable service record.

The attached brief contai ns available perti nent data on the applicant and the factors lead ing to the discharge.

FINDI NG: The Board denies the upgrade of the discharge.

ISSUE: The applicant recei ved a General discharge for Misconduct - Minor Disci pl inary Infractions

The Air Force Discharge Review Board, under i ts responsi bil i ty to examine the propriety and equity of an Applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is wananted. I n reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the appl icant. The Board completed a thorough review of the circumstances that Jed to the discharge and the discharge process to ensure the discharge met the perti nent standards of equity and propriety. The applicant's record of service i ncl uded one Article 15, four Letters of Repri mand and four Letters of Counseli ng. His misconduct included damage to mili tary property; failure to obey an order from a NCO; failure to complete designated running route for squadron PT; displayi ng attitude detrimental to trai n ing environment and disrespect towards an Officer; fai lure to make contact with leadershi p to advise of bei ng late; depa rti ng duty location withou t authori ty; fa i lure to answer the phone and failure to repo1i to duty.

The applicant submitted no issues regard ing the inequi ty or impropriety of his discharge. The Board opi ned that through the administrative actions taken, the appl icant had ample opportun i ti es to change his behavior. They found the seriousness of the wil lful misconduct offset any posi t i ve aspects of the applicant's duty performance. The Board reviewed the entire record and found no evidence of impropriety or ineq u i ty to warran t an upgrade of the discharge.
A discharge is upgraded only i f the applicant and the Board can establish that an ineq ui ty or i mpropriety took place at the time of discharge. After a thorough review of the record, the Board found no evidence to just ify an upgrade of the d ischarge.

CONCLUS ION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substanti ve req u iremen ts of the d ischarge regulation, was within the discretion of the discharge authority, and that the applicant was provided full administrat ive due process.

In view of the foregoing findi ngs, the Board further concludes that there ex ists no legal or equi table basis for upgrade of discharge and detem1ines the discharge should remai n unchanged.
