G EN ERAL: The applicant appeals for upgrade of discharge to Honorable.

The appl icant was offered a personal appearance before the Discharge Review Board (ORB) but decl ined and req uests that the review be completed based on the available service record.

The attached brief contains available perti nent data on the applicant and the factors lead ing to the discharge. FI N DING: The Board -denies the upgrade of the discharge.
ISSUE: The appl ican t recei ved a General discharge for M isconduct - M inor Discipl inary Infract ions

The Air Force Discharge Review Board, under i ts responsibility to examine the propriety and equity of an Applicant's discharge, is authori zed to change the characterization of service and t he reason for discharge i f such change is warranted. I n reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption. to incl ude evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pert inent standards of equity and propriety. The applicant's record of service included one Letter of Repri mand and two Letters of Counseling. Appl ican t" s miscond uct i ncluded k nowingly making false cla im regard ing Bachelor·s degree; fa i l ing to go to duty on time and bei ng financiall y i rresponsible.

The appl icant submi tted no issues regard ing the inequ i t y or i mpropriety of her di. charge. The appl icant cited her desire to recei ve the G.I. Bill benefits as just i ficat ion for upgrade. The OR B noted when the
applicant applied for the G I Bi ll benefi t, she signed a statement (DD Fonn 2366, dated September 2, 200 )
t hat she understood she must recei ve an Honorable discharge to recei ve future educat ional entit lements. The Board was sympathetic to the impact the discharge characteri zation and subseq uent loss of benefits is ha ving on the applicant, but thi s is not a matter of ineq u i ty or impropriety which would warrant an upgrade

CONCLUSION : The Discharge Review Board concl udes that the d ischarge was consistent wi t h the proced ural and substa n t ive requ irements of the discha rge regulation, was wi thi n the discretion of the discha rge authority. and that the applicant was pro' ided ful l adm inistrative due process.

In view of the foregoing find ings, the Board further concl udes that there exists no legal or equitable ba ·is for upgrade of discharge and determine the discharge should rema i n unchanged.
