FD-2014-00155

GENERAL: The applicant appeals for upgrade of discharge to Honorable and change of authori ty for discharge, and change of reenlistment code.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors lead ing to the discharge.

FINDING : The Board denies the upgrade of the discharge, and change of authority for discharge, and change of reenlistment code.

ISSUE: Applicant recei ved a General discharge due to misconduct -Minor Discipli nary Infractions

The Air Force Discharge Review Board, under i ts responsi bi l ity to examine the propriety and equity of an Applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. I n reviewi ng discharges, the Board presumes regulari ty in the conduct of governmental affairs unless there is substant ia l credible evidence to rebut the presumption , to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the perti nent standards of equity and propriety. The Applican t's record of service incl uded an Article 15 for fa i lure to go to duty on time on two separate occasions, disrespectful in language to a SNCO, fa i l ure to be contactable whi le on six ring standby and sleeping on duty.

The member contends that a poor performance report that he recei ved should not have been the basis of his discharge. The applicant stated that he would like to be able to join the Navy. After a thorough review of the records, the Board opined that the appl icant's overall misconduct duri ng his term of enlistment was the reason for his discharge and found no evidence to warrant an upgrade of the discharge characterizat ion. A discharge is upgraded only if the applicant and the Board can establ ish that an inequi ty or impropriety took place at the time of discharge.

CONCLUS ION: The Discharge Review Board concludes that the discharge \vas consistent vvi th the proced ura l and substan tive req uiremen ts of the discharge regulation and was within the discret ion of the discharge authority and the appl ican t was provided ful l administrati ve due process.

In view of the foregoi ng findi ngs, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should remai n unchanged.
