A IR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE		 CASE NUMBER


FD-2014-00634

GENERAL:         The applicant appeals for upgrade of discharge to Honorable, to change the reason and authority for the discharge and to change the reenl istment code.

The applicant was offered a personal appearance before the Discharge Review Board (ORB) but declined and requests that the review be completed based on the available service record.

The attached brief contains ava ilable perti nent data on the applicant and the factors lead ing to the discharge.

FINDING: The Board denies the upgrade of the discharge, the change of reason and authority for discharge and change of reenl istment code.

ISSUE: The applicant recei ved a General discharge for Misconduct - Pattern of Misconduct

The Air Force Discharge Review Board, under i ts responsibility to examine the propriety and equity of an Appl icant's discharge, is authorized to cha nge the characterization of service and the reason for discharge if such change is warranted. In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption , to include evidence submitted by the appl icant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The applicant's record of service included two Article 15's and one Vacation of Non-Judicial Punishment. Applicant" s misconduct included, driving with a suspended license, wrongfully possessi ng with intent to deceive a mi litary identification card, stealing a tube of lipstick and wrongfu lly driving on Fo1t Rucker and Offutt AB after having d ri ving pri vileges previousl y revoked.

The applicant subm itted no issues regard ing the inequi ty or impropriety of her discharge. She wanted the board to know that she is currently serving in the Guard and now has over 1 1 years of service and she would like for her discharge to reflect her maturity. The DRB was pleased to see that the applicant was doing well, however, no inequi ty or impropriety in her discharge was suggested or found in the course of the hea1;ng.
The Board concluded the miscond uct of the applicant appropriately characterized her term of service.

A discharge is upgraded only if the applicant and the Board can establish that an inequity or impropriety took place at the time of discharge. After a thorough review of the record, the Board found no evidence to justify an upgrade of the discharge characterizat ion, reason for the discharge or the reenlistment code.

CONCLUS ION : The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requi rements of the discharge regulation, was within the discretion of the discharge authori ty, and that the appl icant was provided full administrative due process.

In view of the foregoing find ings, the Board fu1ther concludes that there exists no legal or equitable basis for upgrade of discharge and determi nes the discharge should remain unchanged.
