GENERAL: The applicant appea ls for an upgrade of discharge to Honorable and a change of reason to the narrati ve. The applicant was offered a personal appearance before the Discharge Review Board (ORB) but decl ined and requests that the review be completed based on the avai lable service record . The attached brief contains available pertinen t data on the appl icant and the factors lead ing to the discharge. FINDIN G: The Board denies the upgrade of the discharge and change of reason and autho1ity for discharge. ISSUE: The applicant received a General discharge for Misconduct - Pattern of Misconduct
The Air Force Discharge Review Board, under i ts responsi bi lity to examine the propriety and equity of an Appl icant's discharge, is authorized to change the characterizat ion of service and the reason for discharge i f such change is warra nted. I n reviewi ng discharges, the Board presumes regularity i n the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the perti nent standards of equity and propriety. The applicant's record of service i ncl uded one Article 15, one Letter of Reprimand , one Letter of Counseling and two Records of Counsel ing. Her miscond uct incl uded assault by th rowi ng a knife then usi ng a knife to cut someone: wrongfu lly trying to destroy evidence to interrupt an investigation by washing a knife to clean the blood after cutting someone; with intent to deceive, gave untrue statements in regards to bei ng out of uniform (4x); disobeying i nstruct ions from an CO i n regards to hai r standards; failure to compl y with regulat ions: and complai nts from pat ients i n regards to attitude |
