APPLICANT REQUESTS THAT:
He receive Vietnam service credit in order to be eligible for Department of
Veterans Affairs (DVA) benefits.

APPLICANT CONTENDS THAT:
He flew to Vietnam on at least seven different occasions as a loadmaster
and as a medical technician. His records reflect that he was assigned to a
flying position at the hospital located at Eglin Air Force Base as a
surgical technician.
In support of his request, the applicant provided a report of contact to
the DVA and a DD Form 214.
His complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The applicant served in the Regular Air Force for 4 years, 7 months
and 27 days. On 30 April 1976, he received an honorable discharge.

AIR FORCE EVALUATION:
AFPC/DPAPP recommends denial. DPAPP requested that the applicant provide
some documentation reflecting his military service in Vietnam; however, he
did not respond to their request.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 19
September 2008 for review and comment within 30 days. As of this date,
this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. In this respect, persuasive evidence has
not been presented that would corroborate his contention that he flew into
Vietnam on several different occasions. Absent such evidence, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of other persuasive evidence to the contrary, we find no
compelling basis to recommend granting the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

AFPC/DPAPP verified the applicant served at Kadena Air Base (AB), Japan, from 20 Sep 67 to 22 Mar 68, for a total of six months and four days. His CRSC application was disapproved on 3 Sep 03 based on the fact that although his DVA service-connected medical conditions exceeded the 60% rating, his PTSD was determined to be insufficiently documented and was not rated. Even though he did not receive any of the medals or commendations considered to be supportive of stressors and combat exposure, the DVA conceded to his stressful events as due to his duty as a combat photographer.
