RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-2007-04099
            INDEX CODE: 110.00
      COUNSEL: NONE

            HEARING DESIRED: NO

_________________________________________________________________

APPLICANT REQUESTS THAT:

His records be corrected to show he was assigned Temporary Duty (TDY) in
Guam during 1966 and 1967.
_________________________________________________________________

APPLICANT CONTENDS THAT:

He performed duties as a B-52 Bomber Crew Chief while flying over Vietnam,
and would like it indicated on his DD Form 214, Armed Forces of the United
States Report of Transfer or Discharge.

In support of his application, the applicant submits a copy of his DD Form
214.

The applicant's complete submission, with attachments, is at Exhibit A.

_________________________________________________________________

STATEMENT OF FACTS:

The applicant was honorably released from active duty service on 9 Feb 68
for Expiration of Term of Service. He had served four years of active
duty.

In a letter dated 10 Jan 08, the applicant was informed that no
documentation exists in his service records to show he was TDY to Guam
during the time in question. He was asked to provide source documentation
in order to verify his Foreign Service and actual location of his TDY. To
date, this information has not been provided (Exhibit C).

_________________________________________________________________

AIR FORCE EVALUATION:

HQ AFPC/DPAPP recommends denial. DPAPP states no documentation exists to
substantiate the applicant served in Guam or in Vietnam.

The complete DPAPP evaluation is at Exhibit D.
_________________________________________________________________

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 29 Feb
08 for review and comment. As of this date, this office has received no
response (Exhibit E).

_________________________________________________________________

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or
regulations.

2.  The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for the conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

_________________________________________________________________

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
