APPLICANT REQUESTS THAT:
His records be corrected to reflect credit for five months TDY to Vietnam,
in order to qualify for the Vietnam Service Medal (VSM).
His service number be corrected on his DD Form 214.

APPLICANT CONTENDS THAT:
He was TDY to Vietnam on two occasions; in 1968 for two months, and 1970
for three months.
His TDY’s to Vietnam could have exposed him to herbicides used in Vietnam.
In support of his request, applicant provided a copy of his DD Form
214.
The applicant's complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:
The applicant served on active duty in the Air Force from 9 Jan 67 – 8 Jan
71.
His DD Form 214 reflects he served 1 year, 3 months, and 14 days of Foreign
Service.
The Foreign Service on AF Form 7 (Airman’s Military Record) reflects he was
assigned in Taiwan from 28 Sep 67 – 28 Oct 68.
On 8 Jan 71, he was honorably released from active duty in the grade of E-
5, and transferred to the Air Force Reserve.

AIR FORCE EVALUATION:
HQ AFPC/DPAPP recommends denial and states, in part, there were no
documents in the applicant’s military records that show TDYs of any kind
while assigned to Taiwan in 1967/68. Also, that one of the applicant’s
Airman Performance Reports written in 1969 does make reference to a
deployment to England. However, it does not include the location of the
Deployment or the length of the deployment.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 23 Feb 07, a copy of the Air Force evaluation was forwarded to the
applicant for review and comment within 30 days. To date, a response has
not been received.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice regarding applicant’s request for award of
the VSM. The applicant’s contentions are duly noted; however, without
documentation showing specific times and locations of duty in Vietnam, we
are unable to verify his entitlement to the Vietnam Service Medal.
Therefore, in the absence of evidence to the contrary, we find no
compelling basis to recommend granting the relief sought in this
application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

AFPC/DPAPP verified the applicant served at Kadena Air Base (AB), Japan, from 20 Sep 67 to 22 Mar 68, for a total of six months and four days.
