APPLICANT REQUESTS THAT:

He be awarded the Vietnam Service Medal (VSM).

APPLICANT CONTENDS THAT:

He believes he is entitled to the VSM for his service in Vietnam.

In support of his request, the applicant provided a  copy  of  his  DD
Form 214, Armed Forces of the United  States  Report  of  Transfer  or
Discharge.

His complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

Applicant’s military personnel records reflect he enlisted  on  active
duty on 7 December 1961.

On 6 December 1965, he was honorably discharged in the grade of airman
second class (E-3).

He served 4 years on active duty.

AIR FORCE EVALUATION:

AFPC/DPAPP recommends denial.  DPAPP states the  applicant's  military
personnel records did not contain documents verifing  his  service  in
Vietnam.  His records reflect that he served overseas  in  Japan  from
1962 through 1963.  DPAPP asked him to check his personal files to see
if he might have documentation that substantiates his claim to Vietnam
service.  He contacted DPAPP by phone and indicated he  had  no  other
documents to support his contention.   DPAPP  states  based  on  their
review, there are no documents that show a  place  and  time  that  he
served overseas in Vietnam.

AFPC/DPSIDR recommends denial.  DPSIDR states the  applicant  did  not
provide documentation  to  substantiate  service  in  Vietnam  and  in
response to their request for additional information, he indicated  he
had no other documentation to support his claim.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant on
18 April 2008 for review and comment within 30 days.  As of this date,
this office has received no response (Exhibit D).

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice.  After a thorough review  of  the
available evidence and the applicant’s complete submission, we are not
persuaded his records should be corrected to show he was  awarded  the
VSM.  We agree with the  assessments  of  the  Air  Force  offices  of
primary responsibility and adopt their rationale as the basis for  our
conclusion that the applicant has failed  to  sustain  his  burden  of
proof of the existence of  either  an  error  or  injustice.   In  the
absence of evidence to the contrary, we find no  compelling  basis  to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented did  not  demonstrate
the existence of  error  or  injustice;  the  application  was  denied
without a personal  appearance;  and  the  application  will  only  be
reconsidered upon the submission of newly discovered relevant evidence
not considered with this application.
