APPLICANT REQUESTS THAT:
She be awarded the Armed Forces Expeditionary Medal (AFEM) for her service
during the Libyan Crisis (Operation El Dorado Canyon).

APPLICANT CONTENDS THAT:
Her service from 12-17 Apr 86 was in support of the Libyan Crisis. Her
Libya service was not mentioned in any documents because it was classified
as top secret. She was unaware of the criteria for this award until she
was denied an Indiana State education benefit for her son.
In support of her request, applicant provided a copy of her Letter of
Appreciation, Air Force Achievement Medal Citation, and the AFEM criteria.

STATEMENT OF FACTS:
Documentation provided by the applicant reflects applicant served on active
duty in the Regular Air Force from 14 Mar 86 to 9 Nov 88. She was
discharged with a total of 6 years, 5 months, and 20 days active military
service of which 5 years, 6 months, and 28 days was Foreign Service. She
served as a Morse Systems Operator.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends the application be denied and states, in part, that
the applicant did not provide documentation to substantiate her claim that
she participated in direct support of this operation. Additionally, the
applicant’s unit of assignment was not listed as one of the participating
units.
The AFEM is awarded to members of the service who, after 1 Jul 58, have
participated in United States military operations and encountered foreign
opposition, or were in danger of hostile action by foreign Armed Forces.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 20 Oct 06, a copy of the Air Force evaluation was forwarded to the
applicant for review and comment within 30 days. As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force and adopt its
rationale as the basis for our decision that the applicant has failed to
sustain her burden that she has suffered either an error or an injustice.
During the time period in question the AFEM was awarded to servicemembers
who served in direct support of the Libya Operation from 12 Apr 86 through
17 Apr 86. The Air Force OPR has indicated the applicant’s unit was not
listed as one of the participating units deployed into the Area of
Responsibility (AOR) during Operation ELDORADO CANYON and that the
applicant has not provided persuasive evidence to support her request for
award of the AFEM. Therefore, in the absence of evidence to the contrary,
we find no compelling basis to recommend granting the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

Army Regulation 600-8-22 (Military Awards) states the Armed Forces Expeditionary Medal is authorized for qualifying service after 1 July 1958 in military operations within specific geographic areas during specified time periods. DISCUSSION AND CONCLUSIONS: The applicant was assigned to a U.S. Army unit in Germany and there is no evidence that she or her unit participated in Operation El Dorado Canyon.
