He be awarded the Armed Forces Expeditionary Medal (AFEM).

APPLICANT CONTENDS THAT:

He is entitled to award of the AFEM in accordance with DOD  1348.33-M  dated
September 1996.  As a member of the 138th Tactical Fighter  Squadron  (TFS),
he was activated and served in Phalsbourg, France, in support of the  Berlin
Crisis.

Applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Portions of the applicant's military personnel  records  were  destroyed  by
fire in 1973 at the National Personnel Record Center (NPRC)  in  St.  Louis,
Missouri.  The available records indicate the following.

On 1 October 1961, the applicant, who  had  prior  service,  entered  active
duty (EAD) for a period of one year.

On 20 August 1962, the applicant was honorably released from active duty  in
the grade of staff sergeant under the provisions of AFR  39-14.   He  served
10 months and 20 days of total active  duty  service  during  the  contested
time period.

The applicant’s DD Form 214, Armed Forces of the  United  States  Report  of
Transfer or Discharge, with a separation date of  20 August  1962  indicates
he received no decorations and medals.

The AFEM is awarded to members of the service who, after 1 July  1958,  have
participated in United States military operations  and  encountered  foreign
armed opposition, or were in danger  of  hostile  action  by  foreign  Armed
Forces.

AIR FORCE EVALUATION:

AFPC/DPPPR recommended denial indicating after  a  thorough  review  of  the
applicant’s military record, they were unable to find evidence  that  during
the period in  question  that  the  applicant  participated  in  the  Berlin
Crisis.  The applicant was in the  active  Air  Force  for  a  period  of  1
October 1961 to 20 August 1962, and was assigned to the 138th  TFS,  with  a
duty station at Phalsbourg Air Base, France.  There is no  documentation  in
the applicant’s record  to  substantiate  that  he  participated  in  direct
support of this operation.

They were able to verify that the applicant did serve in  overseas  location
for nine months and seven days.  The applicant’s unit of assignment was  not
identified as a participant of the Berlin Crisis.   Further,  the  applicant
did not provide documentation to substantiate his claim  for  award  of  the
AFEM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

The applicant reviewed the evaluation and indicates as members of the  138th
TFS Syracuse, New York, they were  activated  October  1961  through  August
1962 along with other Air National Guard  (ANG)  units  in  support  of  the
Berlin Crisis.  As part of the advance Detachment 1 he helped to  reactivate
the dormant Air Base’s communications prior to the arrival of  aircraft  and
personnel.  He further indicates  several  people  from  this  unit  already
received the AFEM.

The applicant’s response, with attachment, is at Exhibit E.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing  law  or
regulations.

2.    The application was not timely filed; however, it is in  the  interest
of justice to excuse the failure to timely file.



3.    Insufficient relevant evidence has been presented to  demonstrate  the
existence of an error or injustice.  The applicant’s  contentions  are  duly
noted; however, after thoroughly reviewing the  applicant’s  submission  and
the evidence of record there is no indication in  the  applicant’s  military
personnel record that he is entitled to award of the AFEM.  The  applicant’s
records verify that he served overseas for nine months  and  seven  days  at
Phalsbourg Air Base,  France;  however,  his  unit  of  assignment  was  not
identified as a  participant  of  the  Berlin  Crisis.   Therefore,  in  the
absence of evidence  to  the  contrary,  we  find  no  compelling  basis  to
recommend granting the remaining relief sought.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented  did  not  demonstrate  the
existence of an error or an injustice; the application was denied without  a
personal appearance; and the application will only be reconsidered upon  the
submission of newly discovered relevant evidence not  considered  with  this
application.
