APPLICANT REQUESTS THAT:
His record be corrected to reflect satisfactory service for
retention/retirement (R/R) year 21 May 2004 through 20 May 2005.

APPLICANT CONTENDS THAT:
Upon completion of his active duty in October 2001 he became an
Individual Mobilization Augmentee (IMA) at Andrews AFB. He was told
his year for credited service of 50 points was based on fiscal October
dates since that was when he got off active duty and not the May date.
He has served for five years and he just found out he was not given a
full year’s credit for the 2004-2005 R/R year as he had only earned 47
points towards a satisfactory year. He was asked to help with manning
assistance in July 2005 and had in excess of 80 points for 2005-2006.
As he was told his R/R date was October, he believed the 80 points he
earned were actually for R/R year 2004-2005.

STATEMENT OF FACTS:
Applicant was released from the Regular Air Force on 1 October 2001
and assigned to the Air Reserve Personnel Center (ARPC), Obligated
Reserve Section. Reserve Order DA-00356 assigned him to an IMA
position at the 89th Surgical Operations Squadron, Andrews AFB
effective 27 November 2001. That order, in the remarks section
informed the applicant, “your R/R requirement is a minimum of 50
points”, and that “your point history record has not been audited and
your R/R date may change”. His service history was audited on 6 April
2004. In accordance with established regulations, his R/R date was
established as 21 May, the date he was appointed into the Air Force
upon completion of the Health Professional Scholarship Program.

AIR FORCE EVALUATION:
HQ ARPC/DPP recommends denial. DPP states he was notified of
requirements in two separate mailings. One informed him his R/R
requirement was a minimum of 50 points and that his R/R date may
change when a service history audit was completed on his record. The
other letter is automatically sent to all members of the Personnel
Data System when a service history audit has been accomplished and a
new date established.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
22 September 2006 for review and comment within 30 days. As of this
date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After a thorough review of the
evidence of record and applicant's submission, we are not persuaded
that his uncorroborated assertion he was unaware of the change to his
Retention/Retirement year, in and by itself, sufficiently persuasive
to override the rationale provided by the Air Force. Therefore, we
agree with the opinion and recommendation of the Air Force office of
primary responsibility and adopt the rationale expressed as the basis
for our decision that the applicant has failed to sustain his burden
of having suffered either an error or injustice. He was notified
twice by mail of his R/R year audit and subsequent R/R year change.
Therefore, in the absence of persuasive evidence to the contrary, we
find no compelling basis to recommend granting the relief sought in
this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
