APPLICANT REQUESTS THAT:
Her record be corrected reflect a satisfactory year of service for
retention/retirement (R/R) year 22 February 2004 to 21 February 2005.

APPLICANT CONTENDS THAT:
Her R/R date was 5 June and was then changed to 22 February. She was
notified of this change on 8 May 2005. Her Annual Training (AT) was
scheduled for 19 through 22 April 2005 and 18 through 25 May 2005.
Had she been notified of the R/R change at least 13 days prior to 22
February 2005, she would have been able to pull her AT resulting in a
satisfactory year. Through no fault of her own, she is now obligated
to serve an additional year in order to qualify for a Reserve
retirement.
In support of her appeal, the applicant has provided a copy of the
audit letter notifying her of the R/R change.

STATEMENT OF FACTS:
Applicant was released from the active duty Air Force on 1 March 2004
and assigned to HQ ARPC/HC as an Individual Mobilization Augmentee
(IMA) chaplain’s assistant. When her record was gained to the Point
Credit and Accounting System (PCARS) her R/R date was shown as 5 June.
Her service history was audited on 3 May 2005 and her R/R date was
changed to 22 February, the date she initially entered uniformed
service. The change to her R/R date resulted in an unsatisfactory
year of service for R/R year 22 February 2004 to 21 February 2005.
She completed two annual tours on 18 through 22 April 2005 and 16
through 23 May 2005 for a total of 13 active duty (AD) points.

AIR FORCE EVALUATION:
HQ ARPC/DPP recommends denial. DPP contends even if she had known of
the R/R date change earlier and had the opportunity to schedule her AT
dates prior to the new retirement year ending (RYE) date of 21
February 2005 the additional AD points would have resulted in her RYE
21 February 2005 to show only a total of 45 points and a year of
unsatisfactory service. DPP contends had her R/R date of 5 June not
changed, she would still have earned only 46 points, an unsatisfactory
year of service. DPP contends she was already on course for an
unsatisfactory year of service when she was notified in May 2005 of
her R/R date change. This, in addition to her belief that
rescheduling her AT dates prior to the end of RYE 21 February 2005
would have resulted in a year of satisfactory service indicates a lack
of understanding on how to schedule participation for satisfactory
service.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
28 October 2005 for review and comment within 30 days. As of this
date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. The ARPC/DPP contends the applicant
was on track to an unsatisfactory year of service regardless of the
action that changed her retention/retirement (R/R) date from 5 June to
21 February 2005. However, the applicant contends had she been
notified of the change sooner, she would have been able to schedule
her training in a way that would have allowed her to earn a
satisfactory year of service with the new R/R date. Whether or not the
applicant would have been able to earn the necessary points to have a
satisfactory year of service had she been notified sooner of the
change in her R/R date is speculative. However, we believe it was an
injustice to inform the applicant in May 2005 that her new R/R ending
date was February 2005, four months earlier. Therefore, the Board
believes this matter should be resolved in favor of the applicant and
recommend that her records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that she was credited with
an additional 18 non-paid IDT points for retention/retirement year 22
February 2004 through 21 February 2005, resulting in 50 total points;
and, that the period 22 February 2004 through 21 February 2005, is a
year of satisfactory Federal service.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to APPLICANT, be corrected to show that she was
credited with an additional 18 non-paid IDT points for
retention/retirement year 22 February 2004 through 21 February 2005,
resulting in 50 total points; and, that the period 22 February 2004
through 21 February 2005, is a year of satisfactory Federal service.

The other letter the applicant submitted is from an IMA who claims to have also received misguided information when she entered the IMA program. If the Board rules in favor of the applicant, the Board would have to award the applicant 4 non-paid inactive duty training (IDT) points for Retention Year Ending (RYE) 22 April 1996 and 8 non-paid IDT points for RYE 22 April 1997. Insufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice.
