APPLICANT REQUESTS THAT:
She be awarded thirty-five (35) non-pay Inactive Duty Training
(IDT) points to satisfy a year of satisfactory Federal service
for Retention/Retirement (R/R) year ending 16 August 2009. In
addition, her records be considered by a special board for
promotion to major by the Calendar Year 2010 (CY10) Line and
Health Professions Major Position Vacancy (PV) Promotion
Selection Board.

APPLICANT CONTENDS THAT:
Upon entry into the Individual Mobilization Augmentee (IMA)
program on 10 June 2009, her Reserve order listed her
Retention/Retirement (R/R) date as 17 November. She completed
the required Annual Tour (AT) and Inactive Duty Training (IDT)
days by 22 September 2009 to ensure a satisfactory R/R year.
Without her knowledge or notification, her R/R date was changed
to 17 August. When her Promotion Recommendation Form (PRF) came
up for review for the CY10 Line and Health Professions Major
Position Vacancy Promotion Selection Board, the Air Reserve
Personnel Center (ARPC) declared she was ineligible indicating
she did not have a good R/R year as the required points were not
completed prior to 17 August 2009. She believes this is unjust
because she acted in good faith to complete the requirements
based on the original order.
In support of her appeal, the applicant provides copies of her
assignment order, PRF, ineligibility for promotion consideration
letter, commanders letter of support, and her Air National
Guard/United States Air Force Reserve (ANG/USAFR) Point Credit
Summary.

STATEMENT OF FACTS:
According to the military personnel data system, the applicant
is currently serving in the Air Force Reserve in the grade of
captain (O-3) with a date of rank of 17 November 2004. She has
a Total Active Federal Military Service Date and Total Active
Federal Commissioned Service Date of 17 November 2000. The
applicants Point Credit Summary, closing 28 August 2009,
indicates she has seven (7) years of satisfactory Federal
service.

military service records, are contained in the Air Force

AIR FORCE EVALUATION:
ARPC/DPP recommends denial. DPP states the applicant was
released from active duty on 23 February 2007 and assigned to
the ARPC, Non-Obligated, Non-Participating Ready Reserve
Section. Effective 10 June 2009, she was assigned as an IMA to
the Satellite Control and Network System Group, Los Angeles,
California. Her assignment order showed her R/R date as
17 November. The order also indicates in the remarks section
that Your point history record has not been audited and your
R&R date may change.
The applicants point history record was audited 15 July 2009,
in accordance with Air Force Manual (AFMAN) 36-8001, Reserve
Personnel Participation and Training Procedures, Table 2.4. The
audit establishes the R/R date and captures the prior service
history, which is entered in the Point Credit Accounting and
Reporting System (PCARS). This audit also generates a letter to
the member informing them the audit resulted in changing their
R/R date. Her R/R date was established as 17 August, the
initial date entered military service. Her point history and
correct R/R date were available online to the applicant a month
before she started participating and a letter was generated
informing her of this change. The timeliness of the audit was
incredibly prompt.
One month after her prior service and point history and R/R date
was updated in PCARS, the applicant began participating on
17 August 2009, the first day of her current R/R year. The
member completed the IMA program requirements of 12 paid IDTs
and 12 paid AT days, before the end of the 2009 fiscal year
DPP states the applicant is not eligible for special board
consideration for the CY10 Line and Health Professions Major
Position Vacancy Promotion Selection Board, which convened on
1 February 2010. In order to be considered by a PV board, the
officer must have a satisfactory year of service in the R/R year
most recently completed. The applicants most recently
completed year was 16 August 2009. This was an unsatisfactory
year for retirement, so the applicant was not eligible for
consideration by the February 2010 board. She remains
ineligible for special board consideration as the R/R year is
still unsatisfactory. Awarding the applicant a satisfactory
federal service year for what may or may not result in a
promotion, will definitely result in a year towards retirement.
The circumstances have not proved any injustice or error, only
unfortunate timing.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Per AFMAN 36-8001, Table 2.4, Note 2, ARPC/DPPRK is required to
notify both her and her servicing Military Personnel Flight
(MPF) that the R/R date had changed. Neither she nor her
servicing MPF received such notification. Had she been notified
of the R/R date change, she could have adjusted her schedule
appropriately to get the requirements completed by 17 August
2009. Instead, she completed the requirements in good faith
based on the information she had at the time. Subsequent to
their 4 March 2010 memorandum, ARPC/DPP informed her that they
stopped mailing letters of notification two to three years ago.
Additionally, their office was unable to provide a copy of any
R/R change notification allegedly mailed to her.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we found no evidence the individuals records
are in error. We note the applicants contention that she was
not notified of the change of her R/R date; however, her
original assignment order noted in the remarks section that
Your point history record has not been audited and your R&R
date may change. Following the audit of her record, the
updated R/R date was available in the Virtual Military Personnel
Flight (VMPF) approximately one month prior to her performing
any Reserve duty. Had she checked the VMPF she could have
adjusted her training requirements. In addition, any changes
made to a members R/R date generates a computerized
notification from the PCARS which is mailed to the individuals
home address listed in the system. Based on the foregoing, we
conclude the applicant has not been the victim of an error or
injustice. Accordingly, we find no basis to recommend granting
the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.

Based on the audit, the applicant's R/R was changed from 2 October to 14 June. The applicant was notified on 17 April 1999 about the change in his R/R date and that his points were being realigned to coincide with the 14 June R/R date. DPP further states the applicant was notified of the change in his R/R year date in April 1999 and he received an AF Form 526 for RYE 13 June 1999, and furthermore, the applicant had adequate time to earn points for the RYE 13 June 2000.
