RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2006-01517
INDEX CODE: 135.02
COUNSEL: NONE
HEARING DESIRED: NO
_________________________________________________________________
APPLICANT REQUESTS THAT:
Four points be added to her Point Credit summary for the
Retention/Retirement (R/R) year of 4 January 2005 to 3 January 2006.
_________________________________________________________________
APPLICANT CONTENDS THAT:
During 2005, she had made steady progress towards earning a
satisfactory year of service. By mid October 2005, she had
participated to the point she only needed two more days of duty in
order to earn the four additional points needed for her R/R year
ending 3 January 2006 to be considered a satisfactory year towards
retirement. On 11 October 2005, she was prescribed bed rest (earlier
than she expected) and was not able to complete the necessary two days
of duty. Her bed rest and ensuing maternity leave was extended and
moved beyond her R/R date leaving her two days short of a satisfactory
year of service.
In support of her appeal, the applicant has provided copies of her
point credit summary and an AF Form 422, Physical Profile Serial
Report.
Applicant’s complete submission, with attachments, is at Exhibit A.
_________________________________________________________________
STATEMENT OF FACTS:
She began her military career on 31 May 1985 and was progressively
promoted to the grade of lieutenant colonel with a date of rank (DOR)
of 8 March 2003. During her R/R year ending (RYE) 3 January 2006 she
earned only 46 points of the 50 points required to earn a satisfactory
year of service towards retirement. She is currently serving in the
AF Reserve (USAFR) as a lieutenant colonel and has served 19 years, 7
months, and 4 days for pay.
AIR FORCE EVALUATION:
ARPC/DPP recommends denial. DPP finds no injustice in this case.
Even though it was unfortunate she had to be prescribed bed rest, she
is an Individual Mobilization Augmentee (IMA) and being an IMA, she
had an opportunity to schedule participation for non pay during the
months of August and September 2005.
DPP’s complete evaluation is at Exhibit B.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 9
June 2006 for review and comment within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. After reviewing all the evidence
presented in the case, the Board is of the opinion the applicant took
the necessary steps to prepare for her pregnancy and earn a
satisfactory year of service. She admits to anticipating possible bed
rest but also notes her doctor ordered the bed rest sooner than either
of them had anticipated. Not only did these events occur close to the
end of her R/R year, but the bed rest requirement and subsequent
maternity leave extended beyond her R/R year and she ended up four
points short of a satisfactory year for retirement for R/R year 4
January 2005 to 3 January 2006. Due to factors beyond her control
that eventually overwhelmed even those contingencies she planned for
and coupled with her service and excellent participation record over
her career, the Board recommends her records be corrected as indicated
below.
______________________________________________________________
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that she was credited with
an additional four (4) non-paid inactive duty points resulting in 50
total points for the period 4 January 2005 to 3 January 2006, and,
that the period 4 January 2005 to 3 January 2006 was a satisfactory
year of Federal service.

_________________________________________________________________ APPLICANT CONTENDS THAT: She and another unit member contacted HQ Air Force Reserve Command (AFRC) in July 2006 and inquired as to whether or not her duty status needed to be altered on orders. DPP contends even if she had known of the R/R date change earlier and had the opportunity to schedule her AT dates prior to the new retirement year ending (RYE) date of 21 February 2005 the additional AD points would have resulted in her RYE 21 February 2005 to show only a total of 45 points and a year of unsatisfactory service. ______________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating...

Because she was working under the assumption that her R/R date had changed to the date she started working as an ALO (11 August), her R/R year for 27 May 2006 to 26 May 2007 ended up being six (6) points shy of the 50 points required for a satisfactory year of service. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant states she never received a copy of the Special Orders dated 12 Sep 06 in the mail or at her unit. ...

One informed him his R/R requirement was a minimum of 50 points and that his R/R date may change when a service history audit was completed on his record. The other letter is automatically sent to all members of the Personnel Data System when a service history audit has been accomplished and a new date established. After a thorough review of the evidence of record and applicant's submission, we are not persuaded that his uncorroborated assertion he was unaware of the change to...

Four years is a sufficient amount of time for a member to discover the requirements necessary for successful completion in the IMA program and for obtaining a Reserve retirement year. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant finds the Air Force advisory opinion to be unsubstantiated. DPP states that the applicant was voluntarily assigned to an inactive reserve section from 21 November 2001 until 11 September 2002, when he accepted the IMA position. DPP notes that the fact that the member was assigned to inactive status for a majority of his R/R year, plus the fact that he did not earn 35 points during the time he was in a participating assignment, resulted in him not being credited with a satisfactory year of service. We took notice of the applicant's complete...

For her last partial year of Regular active duty, she was correctly credited with 11 months and 21 days of satisfactory service. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion of the Air Force office of primary responsibility that the applicant has not been the victim of an error or injustice as there is no evidence that he did not have sufficient opportunity during the 10 months after his assignment to the 37 th SFS to earn the additional 16 points he needed for a satisfactory year of service for RYE 9 January 2008. The applicant be...
