APPLICANT REQUESTS THAT:
His Officer Selection Record (OSR) for the Calendar Year 2006A (CY06A)
Lieutenant Colonel Central Selection Board (CSB) be corrected to include
the citation for the Air Force Commendation Medal (AFCM) Second Oak Leaf
Cluster (2OLC), for the period 1 February 1999 to 31 January 2002 and that
he receive Special Selection Board (SSB) consideration for promotion to the
grade of Lieutenant Colonel for the CY06A Selection Board.

APPLICANT CONTENDS THAT:
His OSR for the CY06A Lieutenant Colonel CSB did not include his AFCM
(2OLC). When he was made aware of the error, he took the citation to
accompany award of the AFCM (2OLC) to his Military Personnel Flight (MPF)
at Travis AFB and updated his records to reflect three commendations
medals.
In support of his request, the applicant provided documentation extracted
from his military personnel records.

STATEMENT OF FACTS:
Applicant is currently serving on extended active duty in the grade of
major with a date of rank of 1 October 2000.
The applicant was considered and not selected for promotion to the grade of
lieutenant colonel by the CY06A (13 March 2006) Lieutenant Colonel Central
Selection Board.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends denial. DPPPO states although the applicant’s
citation was not on file in his OSR when the board convened, the board
members knew of its existence as evidenced by the entry in the decoration
section of his Officer Selection Brief (OSB). Therefore, the board members
were able to factor it into the promotion selection process. In fact, the
intent of the Memorandum for Record (discrepancy report), 21 February 2006,
filed in his OSR was to ensure the board members were aware that the
officer had been awarded the decorations.
The applicant indicates he made efforts to correct his record at the MPF;
however, he provides no documentation to support his attempts to include
his citation in his OSR. To ensure the contents of the actual OSR were
correct the applicant would have had to request a copy of his record from
HQ AFPC/DPPBR1 (Records Section) as stated in the Military Personnel Flight
Memorandum (MPFM 05-55). If he had done so, he would have noticed the
missing citation, and taken corrective action at that time. It is the
officer’s responsibility to ensure the accuracy of his record at HQ AFPC
prior to the board convening date, not after he has been nonselected for
promotion.
Additionally, while reviewing his OSR - AFPC/DPPPO noticed that the
citation for 1 February 1999 through 31 January 2002 was incorrectly
awarded as the applicant’s 1OLC but should be his 2OLC. This error is
being fixed by his local MPF. However, since this decoration was reflected
in the decorations block (AF COMM MED 2002 3) of the OSB, the board members
were aware of it and factored into the promotion evaluation.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 8 December 2006, the evaluation was forwarded to the applicant for
review and comment within 30 days (Exhibit D). As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. The applicant’s contentions are duly
noted and we took notice of his complete submission in judging the merits
of the case; however, we agree with the opinion and recommendation of the
Air Force and adopt its rationale as the basis for our conclusion that the
applicant has not been the victim of an error or injustice. The Air Force
acknowledges the citation accompanying the AFCM (2OLC) was not filed in the
applicant’s OSR for the CY06A Lieutenant Colonel CSB’s review. Inasmuch as
the award for the AFCM (2OLC) was reflected on his OSB, we believe the
selection board in question had adequate notice that he has received the
award. We are unable to find that the missing information caused his
record to be so inaccurate and misleading that the duly constituted board,
charged with the discretionary authority to scoring records, was unable to
make a reasonable judgment concerning the applicant’s promotability in
relation to his peers. In view of the foregoing and in the absence of
evidence to the contrary, we find no compelling basis to recommend granting
the relief sought.
4. The applicant's case is adequately documented and it has not been
shown that a personal appearance with or without counsel will materially
add to our understanding of the issue involved. Therefore, the request
for a hearing is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not demonstrate the
existence of an error or injustice; the application was denied without a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered with this
application.

The DPPPR evaluation is at Exhibit B. ARPC/DPPPO recommends the Board deny the applicant’s request for SSB consideration.
