APPLICANT REQUESTS THAT:

His Officer Selection Brief (OSB) viewed by the Calendar Year  2006A
(CY06A)  Lieutenant  Colonel  Central  Selection  Board   (CSB)   be
corrected to reflect his joint duty history and  correct  assignment
history.

His Promotion Recommendation Form (PRF) as viewed by  the  CY06A  Lt
Col  CSB  be  amended  to  reflect  a  promotion  recommendation  of
“Definitely Promote” (DP) vice “Promote” (P).

His records be considered for promotion by special  selection  board
(SSB) for the CY06A Lt Col CSB with the requested corrections.

APPLICANT CONTENDS THAT:

The joint duty information on his OSB was missing when  his  records
met the CY06A Lt Col CSB.

The duty Titles on  his  Officer  Performance  Reports  (OPRs)  were
incorrectly reflected on his OSB.  He  understands  he  should  have
seen and corrected this before the promotion board, but in  his  job
at the deployed location, he worked seven days a week  and  received
inadequate support from his command administrative section.

He was told by his rating chain that he was given  a  “P”  promotion
recommendation instead of “DP” because it  was  the  only  way  they
could give both him and an above-the-promotion-zone officer a chance
to get promoted.  His rating chain  thought  that  with  his  strong
records, he had a good chance of getting promoted with a “P.”

In support of his request, applicant provides  a  copy  of  the  OSB
reviewed by the CY06A Lt Col CSB, a copy of an officer surf prepared
on 24 Aug 06, copies of emails documenting his efforts  to  get  his
records updated, and emails discussing his promotion recommendation.

STATEMENT OF FACTS:

The applicant is presently serving on active duty in  the  grade  of
major.  His Total Active Federal Military Service Date  (TAFMSD)  is
18 Sep 91.  The  applicant  was  considered  and  not  selected  for
promotion to the grade of lieutenant colonel by the CY06A Lt Col CSB
(13 Mar 06).  A review of his last 10 OPRs indicates overall ratings
of “Meets Standards.”

AIR FORCE EVALUATION:

AFPC/DPAOS evaluated the applicant’s request to  correct  his  joint
duty information.  They make no recommendation and state it  appears
the applicant’s joint duty information was updated in  the  Military
Personnel Data System (MilPDS) on or after 24 Feb 06 and that  there
are no records to correct for the applicant.

AFPC/DPPPEP recommends denial of the applicant’s request  to  change
the promotion recommendation on his CY06A Lt Col CSB PRF from “P” to
“DP.”

The applicant does not have support from his senior  rater  (SR)  or
management level review (MLR) president as required by AFI  36-2401.
In fact, based on the emails in his package, he does  not  have  the
support of his rater.  The applicant had approximately 30 days after
receiving his PRF to voice concerns to the SR.  Instead,  he  voiced
his concerns to his chain of command after  his  nonselection.   The
chain of command was allowed to provide  input  for  the  PRF,  but,
ultimately, the SR is responsible for the PRF  content  and  rating.
The applicant provided emails from his rating  chain  who  explained
the decision was well thought out and the hard decision was made not
to give the member a “DP” rating based on their opinion of  who  was
entitled to the “DP.”  The procedures used did not violate policy.

AFPC/DPAOM6 recommends the following corrections to the  applicant’s
OSB:

        a.  Add Duty Air Force Specialty Code (DAFSC) “K11H3C”  with
an effective date of 31 Jan 00 to his OSB Assignment History.

        b.  Add a line to the  OSB  Assignment  History,  “Assistant
Flight Commander/Special  Missions  Instructor  Aircraft  Commander”
with an effective date of 31 Jan 00.
AFPC/DPAOM6 defers to AFPC/DPPPO as to whether the applicant  should
be considered for promotion by SSB.

AFPC/DPPPO recommends the applicant’s OSB be  corrected  and  he  be
granted promotion consideration by SSB based  on  these  corrections
only.

The  applicant  provided  documentation  showing  he  exercised  due
diligence to correct his joint  duty  history  prior  to  the  CY06A
board.  As such, they recommend he be provided an SSB with inclusion
of the joint history data on his OSB.   Concerning  the  applicant’s
incorrect assignment history, they note the  applicant  acknowledges
he should have seen and corrected the errors on  his  OSB  prior  to
convening of the  board.   However,  if  the  Board  approves  their
recommendation to grant the applicant an SSB with inclusion  of  his
joint duty data on the OSB, they recommend his assignment history be
corrected as well.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluation were forwarded to  the  applicant
on 20 Oct 06 for review and comment within  30  days.   To  date,  a
response has not been received.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented to demonstrate
the existence  of  error  or  injustice  regarding  the  applicant’s
request to change the promotion recommendation on his  PRF  for  the
CY06A Lieutenant Colonel Central  Selection  Board  from  “Promote,”
“P,” to “Definitely Promote,” “DP.”  After  reviewing  the  complete
evidence of record, we accept AFPC/DPPPEP’s recommendation  to  deny
the applicant’s request and adopt its rationale that the applicant’s
Senior Rater did not violate Air Force  policy  in  awarding  him  a
“Promote” recommendation.  Although we find no basis to  change  the
applicant’s PRF, we note the determination by  AFPC/DPPPO  that  the
applicant exercised due diligence to  get  his  joint  duty  history
updated.  Therefore, we accept their  recommendation  to  grant  the
applicant  promotion   consideration   by   SSB   on   this   basis.
Additionally, we also agree with  their  recommendation  to  include
corrections to the applicant’s OSB assignment  history.   Therefore,
in the interest of equity and justice, we recommend the  applicant’s
records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of  the  Air  Force
relating  to  APPLICANT  be  corrected  to  show  that  the  Officer
Selection  Brief  prepared  for  the  Calendar  Year  2006A  (CY06A)
Lieutenant Colonel Central Selection Board be amended as follows:

              (1)Under the Assignment History Section add  an  entry
effective 31 Jan 00 with a Duty Air Force Specialty Code (DAFSC)  of
“K11H3C” and  duty  title  of  “Assistant  Flight  Commander/Special
Missions Instructor Aircraft Commander.”

              (2)  Under the Joint Duty History Section add an entry
reflecting his joint duty in Pakistan from 15 Oct 04 to 8 Nov 05.

It is further recommended that the corrected  record  be  considered
for promotion to the  grade  of  lieutenant  colonel  by  a  Special
Selection Board for the CY06A Lieutenant Colonel  Central  Selection
Board  and  any  subsequent  boards  in  which  the   above   stated
corrections were not a matter of record.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:

      The pertinent military records of the Department  of  the  Air
Force relating to XXXXXXX, XXXXXXX, be corrected to  show  that  the
Officer Selection Brief prepared for the Calendar Year 2006A (CY06A)
Lieutenant Colonel Central Selection Board be amended as follows:

            a.  Under the Assignment History Section, add  an  entry
effective 31 Jan 00 with a Duty Air Force Specialty Code (DAFSC)  of
“K11H3C” and  duty  title  of  “Assistant  Flight  Commander/Special
Missions Instructor Aircraft Commander.”

            a.  Under the Joint Duty History Section, add  an  entry
reflecting his joint duty in Pakistan from 15 Oct 04 to 8 Nov 05.

      It is further directed that the corrected record be
