APPLICANT REQUESTS THAT:

His Officer Selection Brief (OSB) be corrected to include the award of
the Air Force Meritorious Service Medal, First Oak Leaf  Cluster  (MSM
1OLC) and he receive Special Selection Board (SSB)  consideration  for
promotion to the grade of lieutenant colonel  for  the  Calendar  Year
2006A (CY06A) Lieutenant Colonel Selection Board (CSB).

APPLICANT CONTENDS THAT:

When  he  checked  his  records  in  accordance   with   the   Officer
Preselection Brief (OPB), the MSM was missing because it had only been
finalized days prior to the OPB  release.  Thereafter,  the  personnel
system was unable to properly update the electronic records  prior  to
the board start date. For some reason, AFPC had the  information,  but
the MPF did not. The conflict was not resolved and he had to take  his
copy of the MSM to the local Military Personnel Flight (MPF) to remedy
the situation.

STATEMENT OF FACTS:

The applicant is currently serving on  extended  active  duty  in  the
grade of major.

Applicant was considered and not selected for promotion by  the  CY06A
Lieutenant Colonel Selection Board.

AIR FORCE EVALUATION:

AFPC/DPPPO recommended denial and states the applicant  contends  that
due to the recent Permanent Change of Station (PCS),  his  MSM  (1OLC)
was not updated on his OSB. However, he arrived at Randolph AFB TX  on
12 October 2005; thus giving him more than ample time prior to the CSB
to confirm whether his MSM was correct in the Military Personnel  Data
System (MilPDS), which in turn would have  been  an  indicator  as  to
whether the decoration would have been reflected properly on the  OSB.
He had sufficient time to verify his OSR with AFPC/DPPBR1 and  request
his MSM be included on his OSB by his new CSS or MPF before the  board
convened on 13 March 2006.   As  such,  DPPPO  stands  by  DoD  policy
delivered via AFI 36-2501, para 6.3.2.2., which states, "Do  not  have
an SSB if, by exercising reasonable diligence, the officer should have
discovered the error or  omission  and  could  have  taken  corrective
action before the originally scheduled board convened."

Upon reviewing the applicant's  OSR,  DPPPO  found  the  MSM  was  not
reflected on his OSB. However, the citation was filed in  his  OSR  on
7 December 2005, prior to convening of the board.  As  such,  although
the decoration was not listed on his OSB, the citation  was  available
to the board  members  for  their  review  and  consideration  in  the
promotion selection process. Updating his CY06A OSB  to  include  this
decoration  would  not  introduce  any  new  information  not  already
considered  by  the  board.  Therefore,  SSB  consideration   is   not
warranted.

Although the applicant’s Officer Selection Brief (OSB) did not reflect
award of the MSM (1OLC), a copy of the citation was filed in  the  OSR
on 7 December 2005.   Since  the  board  members  were  aware  of  the
decoration and  its  content,  it  was  factored  into  their  overall
promotion  evaluation.   Therefore,  we  do  not   support   promotion
reconsideration on this matter.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 4
August 2006, for review and comment.  As of this date, no response has
been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of an  error  or  injustice.   We  took  notice  of  the
applicant's complete submission in judging the  merits  of  the  case;
however, we are not persuaded that his request for SSB  is  warranted.
At the time the applicant’s record was considered for promotion to the
grade of lieutenant colonel by  the  CY06A  board,  his  OSB  did  not
reflect the MSM (1OLC); however, the citation  was  available  to  the
board members. We believe that this error was not so egregious  as  to
not provide him a fair  and  equitable  promotion  consideration.   In
addition, we are not persuaded by his contentions  that  he  exercised
due diligence in making sure the correction was processed prior to the
board and thereby ensure that his records were correct  prior  to  the
convening of the  promotion  board.   Therefore,  in  the  absence  of
evidence to the contrary, we find no  compelling  basis  to  recommend
granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
