APPLICANT REQUESTS THAT:

An Air Medal (AM) be added to his Officer Selection  Brief  (OSB),  an
Intermediate Developmental Education (IDE) select for 2006 be  removed
his OSB, and he be considered by a Special Selection Board  (SSB)  for
the calendar year 2006A (CY06A) Lieutenant Colonel  Central  Selection
Board (P0506A) that convened on 13 March 2006.

APPLICANT CONTENDS THAT:

He was awarded an AM on 15 February 2006 but the award did not make it
into his  records  prior  to  the  CY06A  Lieutenant  Colonel  Central
Selection Board (CSB).  He could  not  forward  the  award  order  and
citation to the promotion board because he did not receive them  until
after the board had met.  The IDE selection dated in 2006 is incorrect
as he was not nominated as a third-look IDE select.

In support of his appeal, the applicant has provided copies of the  AM
order and citation as well as copies of his  erroneous  and  corrected
OSB’s.

STATEMENT OF FACTS:

He was commissioned in the Regular Air Force on 8  November  1991  and
graduated from Undergraduate Pilot Training (UPT) on  1 October  1992.
He has been progressively promoted to the grade of major with  a  date
of rank (DOR) of 1 March 2002.  He now has  one  nonselection  to  the
grade of lieutenant colonel as he was not selected  for  promotion  by
the P0506A Lieutenant Colonel CSB.  He is currently serving in the Air
Force and has approximately 14 years of service.
AIR FORCE EVALUATION:

HQ AFPC/DPAFE considered the IDE select portion of his application and
recommended denial.  DPAFE states he was designated as a “select”  for
professional  military  education  (PME)  from  the   P0401A   Major’s
promotion board.   Officers  designated  as  PME  selects  from  their
promotion boards are coded  in  the  Military  Personnel  Data  System
(MilPDS) to identify their “select” status.  The code used to identify
the select status is given an expiration date in  the  summer  of  the
last possible year the officer could graduate from PME.  The last year
of eligibility to apply for IDE for the P0401A promotion board was  in
2004 for attendance in academic year (AY) 2005-2006.   Therefore,  the
IDE select status with a 2006 expiration date on  his  P0506A  OSB  is
correct.

DPAFE’s complete evaluation is at Exhibit B.

HQ AFPC/DPPPO considered the portion of the application  dealing  with
the applicant’s request for an SSB and recommends denial.  DPPPO cites
Air  Force  Instruction  (AFI)  36-2803,  The  Air  Force  Awards  and
Decorations  Program,   wherein   it   is   stated   that   decoration
recommendations are entered “into official channels within 2 years and
awarded within 3 years of the act, achievement, or service performed.”
 In addition, citations and special orders must be forwarded within 30
days of the date of the special order.  Therefore, the  special  order
and citation were processed within the  guidelines  of  the  governing
directive  and  neither  was  due  for  file  until  15  March   2006.
Consequently, the AM was not required to be on file for the board.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant on
19 January 2007 for review and comment within 30  days.   As  of  this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to demonstrate the
existence of error  or  injustice.   It  appears  his  Air  Medal  was
prepared and in the system with time for it to be included on the  OSB
that met the CY06A Lieutenant Colonel Central Selection Board and  but
for an apparent administrative oversight would have been.  With a  30-
day window to forward citations and special orders, we  note  his  was
forwarded just two days after the P0506A Board  convened.   Therefore,
in view of the above and in order to preclude the  possibility  of  an
injustice to the applicant, we recommend that his records be corrected
as indicated below.

4.  With regard to his  request  that  an  Intermediate  Developmental
Education (IDE) select for 2006 be removed from his record,  we  agree
with the opinion and recommendation of the Air Force office of primary
responsibility that the IDE select status with a 2006 expiration  date
on the applicant’s P0506A OSB is correct and adopt  its  rationale  as
the basis for our conclusion that  the  applicant  has  not  been  the
victim of an error or injustice.  The  last  year  of  eligibility  to
apply for  IDE  for  the  P0401A  promotion  board  was  in  2004  for
attendance in academic year 2005-2006. Therefore, in view of the above
and in the absence of evidence to the contrary, we find no  compelling
basis to recommend granting the relief sought.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that his Officer Selection
Brief (OSB), prepared for consideration by the calendar year 2006A
(CY06A) (13 Mar 06) (P0506A) Lieutenant Colonel Central Selection
Board (CSB), be corrected to show that:

            a. The Air Medal awarded for the period 8 October 2005 to 28
December 2005, be added to his OSB

            b.  He  be  considered  for  promotion  to  the  grade  of
lieutenant  colonel  by  Special  Selection  Board  for   the   P0506A
Lieutenant Colonel CSB.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating to APPLICANT, be corrected to show that his Officer
Selection Brief (OSB), prepared for consideration by the calendar year
2006A (CY06A) (13 Mar 06) (P0506A) Lieutenant Colonel Central
Selection Board (CSB), be corrected to show that:

            a. The Air Medal awarded for the period 8 October 2005 to
28 December 2005, be added to his P0506A OSB.

            b.  He  be  considered  for  promotion  to  the  grade  of
lieutenant  colonel  by  Special  Selection  Board  for   the   P0506A
Lieutenant Colonel CSB.
