APPLICANT REQUESTS THAT:
1. His Officer Pre-Selection Brief (OPB) used for the CY05B (P0405B)
promotion board be substituted with one that displays his complete duty
history.
2. The number of Air Force Commendation Medals (AFCM) in his records be
changed from five to four.
3. His corrected record be considered by a Special Selection Board (SSB)
for promotion to the grade of major by the CY05B Major Central Selection
Board.

APPLICANT CONTENDS THAT:
The OPB along with the PRF is the first document used by promotion boards
to assess an officer, giving a critical overview of his career and
potential. He believes if the following leadership positions were included
on his OPB: Squadron Section Commander, Operations Group Executive Officer
and Commander, Support Flight at Joint Task Force Bravo it would have
demonstrated his readiness for increased leadership. In addition, the
correct OPB would demonstrate his diverse assignments to USAFE, ACC, AFMC,
PACAF and his three Chaplain Candidate tours.
In support of his request, applicant provided a personal memorandum, a copy
of his assignment history and copies of his selection brief.

STATEMENT OF FACTS:
Information extracted from the Military Personnel Data System (MilPDS)
indicates the applicant is currently serving on active duty in the grade of
captain, with a date of rank of 30 June 1997. As of 11 October 2006, the
MilPDS reflects one nonselection to the grade of major.
AFPC has updated the Military Personnel Data System to reflect four AFCM’s
instead of five.

AIR FORCE EVALUATION:
AFPC/DPAH states they find the applicant’s assertion he was not promoted
because of an inaccurate OPB to be possible. They also believe it is
difficult to imagine the board was unaware of his previous experience since
the OPRs were in his promotion folder. However, DPAH states the fact
remains an inaccurate OPB could have influenced the Board actions. They
further state the only equitable avenue may be to grant an SSB.
The DPAH evaluation is at Exhibit C.
AFPC/DPPPO recommends denial. DPPPO states the errors identified by the
applicant should have been identified prior to the central selection board
(CSB). AFI 36-2501, Officer Promotions and Selective Continuation states
officers as a minimum must review their OPB for accuracy of personal data
and make corrections prior to the convening of the board. The applicant
does not provide an explanation or documentation to show what action he
took to correct his OSB to ensure his record was accurate prior to the
board convening. Applicant also had the option of submitting a letter to
the board president to address his incorrect duty history and incorrect
number of AFCM’s; however, applicant did not exercise this option.
Although his OSB reflected the incorrect duty history, his Officer
Performance Reports contained the correct information which the board
reviewed and took into consideration in evaluating his record. As such,
the corrected duty history data does not introduce any new information that
was not already considered by the board. AFI 36-2501 states SSBs will not
convene if by exercising reasonable diligence the officer should have
discovered the error and could have taken corrective action before the
originally scheduled board convened. The applicant failed to exercise
reasonable diligence in ensuring his record was accurate prior to the CSB;
therefore, we recommend the request for SSB consideration be denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 29
September 2006 for review and comment within 30 days. As of this date,
this office has received no response (Exhibit E).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We have reviewed the available evidence
pertaining to the applicant’s assertions related to his duty title
correction and incorrect number of AFCM’s on his OPB and we are not
persuaded that SSB consideration is warranted. His assertions in this
regard are duly noted; however, in our opinion, the Air Force office of
primary responsibility (DPPPO) has adequately addressed these contentions
and we are in agreement with their assessment that he failed to exercise
due diligence in ensuring his records were accurate. In the absence of
documentation showing what action he took prior to the convening of the
board which would demonstrate reasonable diligence in the maintenance of
his records, we do not believe SSB consideration is appropriate.
Therefore, in the absence of evidence to the contrary, the applicant’s
request is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; the application was denied
without a personal appearance; and the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
