APPLICANT REQUESTS THAT:

1. His security data be updated to reflect his current clearance date.

2. His Officer Selection Brief (OSB) for the  Calendar  Year  2005B  (CY05B)
Major Central Selection Board (CSB) be  corrected  to  reflect  his  correct
duty  history  and  that  he   receive   Special   Selection   Board   (SSB)
consideration for promotion to the grade of Major for  the  CY05B  Selection
Board.

APPLICANT CONTENDS THAT:

Prior  to  the  CY05B  promotion  board  he  submitted  corrections  to  his
servicing  Military  Personnel  Flight  (MPF).   He  found  out  after   his
nonselection that the errors were never corrected.  His current  duty  title
should read Chief, DMAG Capital Investments, his duty history  contains  two
incorrect duty titles (MAJCOM Financial Analyst Working  Capital  Funds  and
Chief of Business OPS RDSMO) which should be deleted, and his security  data
should reflect his current clearance date.   He  would  like  his  corrected
record to be considered by a supplemental promotion board.

In support of his request, the applicant provided a personal  statement  and
an Officer’s SURF dated 3 April 2006.

STATEMENT OF FACTS:

The applicant is currently serving on extended active duty in the  grade  of
captain effective and with a date of rank (DOR) of 28 May 2001.

The applicant was considered and not selected for promotion to the grade  of
Major by the CY05B (5 December 2005) Major CSB.

The Officer Selection Brief (OSB) prepared for  the  CY05B  Selection  Board
did not reflect the correct duty history (18 November 2005  and  27  January
2005 entries) in the Assignment History section.

On 8 May 2006, AFPC/DPASA advised the applicant that  changes  to  his  duty
history and duty title have been accomplished.   His  duty  title  currently
reflects, “Chief, DMAG Capital Investments,” and his duty history no  longer
reflects the entry, “65F3 Chief of  Business  Ops  RDSMO  12  Space  Missile
Systems Center, Kirtland AFB, NM.”

AIR FORCE EVALUATION:

AFPC/DPPPO recommends  denial.   DPPPO  states  the  applicant  provides  no
documentation showing he submitted corrections  to  his  MPF  prior  to  the
board and that he followed up  to  ensure  the  contested  errors  had  been
corrected on his OSB.  He clearly did not exercise reasonable  diligence  in
maintaining  his  record.   The  Military  Personnel  Data  System  (MilPDS)
reflects his correct duty history.  DPPPO does  not  believe  the  contested
assignment history errors on his OSB caused his nonselection  for  promotion
to major.

Although an officer’s security data is reflected on the Officer SURF, it  is
not one of the items listed on OSBs and therefore, not viewed by  the  board
members in the promotion selection process.  The applicant does not  have  a
basis for this request.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

The applicant reviewed DPPPO’s evaluation and states he  never  received  an
Officer Preselection Brief (OPB) for the CY05B Major’s Board.  He  retrieved
a copy of his records and requested  on  three  separate  occasions  to  his
servicing MPF that the appropriate corrections be made.  He  was  under  the
impression on his final request that the changes had been made.

After his nonselection, he contacted personnel at the  Air  Force  Personnel
Center (AFPC) and was advised  that  the  errors  in  his  record  may  have
contributed  to  his  nonselection.   He  believes  a  second  look  at  his
corrected record may be favorable to his position.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing  law  or
regulations.

2.    The application was timely filed.

3.    Insufficient relevant evidence has been presented to  demonstrate  the
existence of an error or injustice.   We  took  notice  of  the  applicant's
complete submission in judging the merits of the case; however, we  are  not
persuaded  that  his  request  for  SSB  is  warranted.   At  the  time  the
applicant’s record was considered for promotion to the  grade  of  major  by
the CY05B board, his OSB contained erroneous information in  the  assignment
history.  These errors have since been corrected in the MilPDS.  We  believe
that these errors were not so egregious as to not provide  him  a  fair  and
equitable promotion consideration.  In addition, we  are  not  persuaded  by
his contentions that the applicant exercised due diligence  in  making  sure
the corrections were processed prior to the board and  thereby  ensure  that
his records were correct prior to the convening of the promotion board.   In
view of the above, we are compelled to  conclude  that  the  incorrect  duty
history  on  the  OSB  constituted  nothing  more  than   harmless   errors.
Therefore,  in  the  absence  of  evidence  to  the  contrary,  we  find  no
compelling basis to recommend granting the relief sought.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented  did  not  demonstrate  the
existence of an error or an injustice; the application was denied without  a
personal appearance; and the application will only be reconsidered upon  the
submission of newly discovered relevant evidence not  considered  with  this
application.
