APPLICANT REQUESTS THAT:
His Officer Selection Record (OSR) prepared for the Calendar Year 2005B
(CY05B) Central Major Selection Board be corrected to include the award of
the Air Force Commendation Medal (AFCM), First Oak Leaf Cluster (1OLC) for
the period 24 October 1999 to 7 November 2001 and that he be considered
for promotion to the grade of major by a Special Selection Board (SSB) for
the CY05B Central Major Selection Board.

APPLICANT CONTENDS THAT:
During a records review, he noticed that Spangdahlem Military Personnel
Flight was missing one AFCM citation in his unit personnel record group
(UPRG). During telephonic records review in September, AFPC had the missing
citation. Neither he nor AFPC noticed that his official record was missing
the citation that was in his UPRG at Spangdahlem. Since AFPC had the
citation he was missing, it was assumed that AFPC also had the other one.
With this citation missing, it appears that he did not receive a change of
station medal from Pope AFB.
In support of his application, applicant provided a copy of the AFCM
citation and special order #GO-066.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade of captain.
He was considered and not selected for promotion to the grade of major by
the CY05B Central Major Selection Board.
The applicant was awarded the AFCM 1OLC for service performed during the
period 24 October 1999 to 7 November 2001.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends denial. The applicant contends that his AFCM 1 OLC,
awarded by Special Order GO-066, dated 3 February 2004, was not reflected
in his OSR. Although the decoration was not reflected in his OSR, the AFCM
was available on the applicant's Officer Promotion Brief (OSB). Therefore,
the Board members were able to factor it into the promotion process.
Furthermore, the board Discrepancy Report, 17 November 2005, filed in his
OSR indicated that the OSR was not updated to reflect the most recent AFCM.
This would have called attention to the fact that there was a medal
citation for that period in the OSR. Including a hardcopy of his AFCM would
not introduce any new information not already considered by the board.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant reviewed the Air Force evaluation and stated he believes that
DPPPO office did not fully consider the steps he took to review his OSR.
Their recommendation also does not address the failure of Spangdahlem's MPF
to respond to an official Discrepancy Report dated 17 November 2005.
Finally, there is no mention of the efforts taken on his part to review his
OSR and what led to the AFCM citation not getting into his record prior to
the board.
Early October 2005, knowing that his major board was approaching, he and
another captain went through the exact same process to review their
records. Calling to review his records was described as a perfectly
acceptable means to fulfill due diligence. He also felt confident that he
had done all the review necessary to assure his records were correct. It
was not practical to travel from Germany to review his records in person
since he had no cause to believe there were any discrepancies needing
personal attention. It was not apparent during his telephone review that he
had one citation and AFPC had the other, but neither of them had both. If
this would have been noticed, he would have been able to send the missing
citation. While there was a number 2 next to AFCM on his officer promotion
brief (OPB), there was only one citation; the board would have been able to
review any of the comments. The missing citation could have sent the wrong
message to the board that he did not care enough to review his records.
This is clearly not the case, and he would appreciate SSB consideration.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. After reviewing the complete case
file, we note that the applicant’s Officer Selection Brief (OSB) did not
reflect the award of the AFCM (1OLC) and the correct assignment history
during the CY05B Major Central Selection Board. In this regard, we noted
that a Board Discrepancy Report was filed in his Officer Selection Record
(OSR) indicating the personnel data system was not updated. While we
cannot state with certainty that the inaccurate information was the cause
of the applicant’s nonselection for major, we do believe it may have
prevented his receiving full and fair consideration by the promotion board.
In view of the foregoing and in an effort to remove any possibility of an
injustice to the applicant, we recommend that his record, to include his
corrected OSR reflecting the citation of the award and assignment history,
be considered for promotion, to the grade of major by a Special Selection
Board (SSB) for the CY05B Selection Board.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that:
a. The Officer Selection Brief (OSB) prepared for the Calendar
year 2005B Major Selection Board be amended to reflect the award of the Air
Force Commendation Medal, First Oak Leaf Cluster for the period 24 October
1999 to 7 November 2001.
It is further directed that his record, to include the above corrected OSB,
be considered for promotion to the grade of major by Special Selection
Board for the Calendar Year 2005B Major Selection Board.

Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air
Force relating to XXXXXXX, XXXXXXX, be corrected to show that:
a. The Officer Selection Brief (OSB) prepared for the
Calendar year 2004B Major Selection Board be amended to reflect the award
of the Air Force Commendation Medal, First Oak Leaf Cluster for the period
