APPLICANT REQUESTS THAT:
His records reflect that he was on temporary duty (TDY) to Vietnam from 1
to 17 October 1968.

APPLICANT CONTENDS THAT:
The Department of Veterans Affairs (VA) diagnosed him as having Type 2
Diabetes. Diabetes, stress and agent orange are life threatening to him.
He indicates that he filed a claim and it was denied because his records do
not reflect his time served in Vietnam. He was stationed with XXX AMS,
Davis Monthan AFB, AZ.
In support of his appeal, the applicant provided a personal statement.

STATEMENT OF FACTS:
During the time period in question, the applicant enlisted in the Regular
Air Force on 18 October 1964 in the grade of airman first class with a date
of rank of 1 October 1962, for a period of four (4) years.
The applicant retired on 30 November 1976, in the grade of staff sergeant,
under the provisions of AFM 35-7. He served 20 years and 19 days of total
active military service.

AIR FORCE EVALUATION:
AFPC/DPAPP2 recommended denial. They indicated that there is no indication
in the applicant’s master personnel records (MPR) that he was TDY to
Vietnam. He was previously advised on 30 October 1991, that no documents
existed in his records that support his claim for service in Vietnam.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 7 February 2003, a copy of the Air Force evaluation was forwarded to the
applicant for review and response within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force and adopt their
rationale as the basis for our conclusion that the applicant has not been
the victim of an error or injustice. There are no documents in the
applicant’s military personnel records that reflect that he was stationed
or sent TDY to Vietnam during his tour of duty in the Air Force. Moreover,
he has not submitted any documentation to support his assertion that he was
TDY to Vietnam from 1 to 17 October 1968. In view of the above finding, we
find no compelling basis to recommend granting the relief sought.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of an error or an injustice; that the application was denied
without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

The VA told him to bring in his TDY records which he doesn’t have. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP2 recommends the application be denied. While the possibility exists that the applicant may have been in Vietnam at some time, he has provided no evidence substantiating he was deployed to Vietnam for any specific dates or length of time.
The applicant was requested to provide any documents from his personal files in support of his application and he has not responded to the request. They recommend the requested relief be denied (Exhibit D). There was no evidence in the applicant's records to support he served in Korea or Vietnam.
