APPLICANT REQUESTS THAT:
In the applicant’s request for reconsideration, he requests his records
reflect he was on temporary duty (TDY) to Vietnam from 1 to 17 October
1968.

STATEMENT OF FACTS:
In an application to the Board dated 20 December 2002, the applicant
requested his records reflect he was TDY to Vietnam. On 12 June 2003, the
Board considered and denied the applicant’s request. A complete copy of
the Record of Proceedings (ROP) is at Exhibit E.
On 12 May 2004, the applicant submitted a request for reconsideration,
indicating his DD Form 214 should indicate combat zone - Vietnam in October
1968. He obtained a military pay order which indicates airman
authorization - combat zone exempt. He states he is being denied many
military benefits due to this error (Exhibit F).
EXAMINER’S NOTE: HQ AFPC/DPAPP1 advised the Board staff informally their
review of the document submitted by the applicant which included a
telephone call to DFAS, does not verify Vietnam service. They noted the
N/A in the block referring to Combat Zone exemption is partially lined out
on the DD Form 114 - Military Pay Order. The date of June 4, 1970, means
the document was examined by an examiner on that date (Info Tab).

FINDINGS AND CONCLUSIONS OF THE BOARD:
After again reviewing this application and the evidence provided in support
of the appeal for reconsideration, we are again not persuaded the applicant
has been the victim of either an error or an injustice. As noted in our
original decision, there are no documents in the applicant’s military
personnel records which reflect he was stationed or sent TDY to Vietnam
during his tour of duty in the Air Force. The Board took notice of the DD
Form 114 - Military Pay Order, the applicant submitted. However, it would
appear the block referring to Combat Zone Exempt status has been marked
N/A, in other words, it did not apply to the applicant. The June 4, 1970
date reflected in this block would appear to be the date an examiner
reviewed this document. In view of this finding, we again conclude the
applicant has not established to our satisfaction that he has been the
victim of an error or injustice. Therefore, in the absence of evidence to
the contrary, we find no compelling basis to recommend granting the relief
sought.

DECISION OF THE BOARD:
The applicant be notified that the evidence presented did not demonstrate
the existence of an error or injustice; that the application was denied
without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

He indicates that he filed a claim and it was denied because his records do not reflect his time served in Vietnam. In support of his appeal, the applicant provided a personal statement. There are no documents in the applicant’s military personnel records that reflect that he was stationed or sent TDY to Vietnam during his tour of duty in the Air Force.

The applicant's records do not reflect that he was TDY to Ubon, Thailand.
The VA told him to bring in his TDY records which he doesn’t have. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP2 recommends the application be denied. While the possibility exists that the applicant may have been in Vietnam at some time, he has provided no evidence substantiating he was deployed to Vietnam for any specific dates or length of time.

In his latest submission, the applicant provides documents extracted from his personal copy of his military personnel records; in particular, a Combat Zone Certificate for Tax Exemption indicating that he was in the Combat Zone on 27 Sep 67, a letter from the Chief, Accounting and Finance Branch reflecting he received taxable income exclusions for his service in the Vietnam Combat Zone for the 1-31 Dec 67; AF Forms 626, Temporary Duty Order Military, indicating he was on temporary duty...
