APPLICANT REQUESTS THAT:

His reenlistment date of 1 Jan 02 be changed to 2 Jan 02 in  order  to
qualify for a higher Selective Reenlistment Bonus (SRB) entitlement.

APPLICANT CONTENDS THAT:

His reenlistment was not due until Feb 02.  However, due to  his  duty
location, he wanted to reenlist  as  soon  as  possible  in  case  the
paperwork got lost in transit.

In support of his  request,  the  applicant  submits  a  copy  of  his
deployment  orders.   The  applicant’s   complete   submission,   with
attachment, is at Exhibit A.

STATEMENT OF FACTS:

The applicant’s Total Active Federal Military Service Date (TAFMSD) is
27 Aug 97.  He is currently serving on active duty  in  the  grade  of
senior airman (E-4), with an effective date of rank of 27 Aug 00.

The remaining relevant facts pertaining to this application, extracted
from the applicant’s military records, are  contained  in  the  letter
prepared by the appropriate office of the Air Force at Exhibit C.

AIR FORCE EVALUATION:

HQ AFPC/DPPAE recommends the application be denied.  DPPAE stated that
the applicant reenlisted on 1 Jan 02 for 4 years and 2 months.  On  17
Jan 02, HQ  USAF  released  a  new  SRB  list  that  changed  the  SRB
entitlement for the applicant’s Air Force Specialty Code  (AFSC)  from
1.0 to 2.0 and announced that affected personnel  should  be  briefed.
The window to get the SRB recomputed  was  if  the  member  reenlisted
between 2 Jan 02 and 16 Jan 02.  The  SRB  review  was  not  announced
during the timeframe the applicant reenlisted; therefore, the Military
Personnel Flight (MPF) could not have briefed the  applicant  that  an
SRB review was taking place.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

The applicant reviewed the advisory opinion and indicated that, due to
his being in an austere location  in  support  of  Operation  Enduring
Freedom, the window to get an SRB recomputed should be looked into and
carefully considered.  His enlistment would not have  ended  until  26
Feb 02.  If it had not been for the  circumstances  at  the  time,  he
would not have reenlisted as early  as  1  Jan  02.   The  applicant’s
complete submission, with attachments, is at Exhibit E.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to demonstrate the
existence of injustice.  After reviewing  the  applicant’s  submission
and the evidence of record, we are persuaded that relief is warranted.
 We note that the applicant’s decision to reenlist early  was  due  to
his pending  deployment  to  an  austere  location.   Apparently,  the
applicant was informally  notified  that  there  were  numerous  cases
concerning the paperwork of deployed members being  lost  in  transit,
resulting in the members being  discharged.   To  preclude  this  from
happening to him, he decided to reenlist prior to his deployment.  Had
it not  been  for  this  deployment,  the  applicant  would  not  have
reenlisted early and therefore would have been automatically  eligible
for the greater reenlistment bonus.   In  view  of  the  circumstances
presented in this case, and in an effort to remove any possibility  of
an injustice to the applicant, we recommend his records  be  corrected
to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT be corrected to show that:

      a.  He was not honorably discharged on 31 December 2002 and  his
1 January 2002 reenlistment in the Regular Air Force for a  period  of
four (4) years be, and hereby is, declared void.

      b.  He was honorably discharged on 1 January 2002 and reenlisted
in the Regular Air Force on 2 January 2002 for a period  of  four  (4)
years; and, at the time of his reenlistment on 2 January 2002, he  was
entitled to a Zone A, multiple 2.0 Selective Reenlistment Bonus (SRB).

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating to APPLICANT be corrected to show that:

            a.  He was not honorably discharged on 31 December 2002
and his 1 January 2002 reenlistment in the Regular Air Force for a
period of four (4) years be, and hereby is, declared void.

            b.  He was honorably discharged on 1 January 2002 and
reenlisted in the Regular Air Force on 2 January 2002 for a period of
four (4) years; and, at the time of his reenlistment on 2 January
2002, he was entitled to a Zone A, multiple 2.0 Selective Reenlistment
Bonus (SRB).
