                            RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: 02-01315
                       INDEX CODE: 110.00
      APPLICANT COUNSEL: None

      SSN HEARING DESIRED: No

_________________________________________________________________

APPLICANT REQUESTS THAT:

His date of reenlistment be changed from 11 December 2001 to 29
January 2002 to qualify for a higher Selective Reenlistment Bonus
(SRB).

_________________________________________________________________

APPLICANT CONTENDS THAT:

The reasons the applicant believes the records to be in error or
unjust and the evidence submitted in support of the appeal are at
Exhibit A.

_________________________________________________________________

STATEMENT OF FACTS:

The relevant facts pertaining to this application, extracted from the
applicant's military records, are contained in the letter prepared by
the appropriate office of the Air Force.

_________________________________________________________________

AIR FORCE EVALUATION:

AFPC/DPPAE states HQ USAF released the new SRB list on 17 January
2002. In order to qualify for a recomputed SRB, the service member
must have reenlisted between 2 January 2002 and 16 January 2002. The
applicant reenlisted on 11 December 2001 before the SRB review had
been announced and therefore the MPF was unable to brief him about the
change. DPPAE recommends the requested relief be denied (Exhibit C).

_________________________________________________________________

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the Air Force evaluation was forwarded to the
applicant on 7 June 2002, for review and response. As of this date,
no response has been received by this office.

_________________________________________________________________

THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by existing
law or regulations.

2. The application was timely filed.

3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. The applicant states he was told
by his local MPF that the SRB review would be postponed until the Stop-
Loss was no longer in effect. However, he has not provided any
documentation to support this assertion. After careful consideration
of the circumstances of this case and the evidence provided by the
applicant, we are not persuaded his request to have his date of
reenlistment changed is warranted. The applicant reenlisted before
the change in the SRB was announced and he was not in the window of
eligibility for having the SRB recomputed. Applicant’s contentions
are duly noted; however, we agree with the opinion and recommendation
of the Air Force and adopt their rationale as the basis for our
conclusion that the applicant has not been the victim of an error or
injustice. However, should the applicant provide documentation from
the MPF substantiating his assertions, the Board would be inclined to
review this case for possible reconsideration. Therefore, in view of
the foregoing, the Board finds no compelling basis to recommend
granting the relief sought in this application.

_________________________________________________________________

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

The SRB review had not been announced as of the date the applicant reenlisted and therefore the MPF was not able to brief the applicant it had changed. However, we have been advised by the Air Force Personnel Center (AFPC) that the applicant’s Air Force Specialty Code (AFSC) was affected by the STOP LOSS program which was in effect at the time. Therefore, had he not reenlisted in December 2001, he would not have been allowed to separate on January 13, 2002; rather, an extension of his...
