APPLICANT REQUESTS THAT:
He be given a constructive reenlistment to qualify for a higher Selective
Reenlistment Bonus (SRB).

APPLICANT CONTENDS THAT:
The reenlistment bonus was changed from a 1.0 to a 2.0 approximately 20
days after his reenlistment. He would like to change his reenlistment date
to 30 January 2002 in order to take advantage of the higher reenlistment
bonus. He understands this will extend his active duty service commitment
(ADSC) to 30 January 2008.
In support of his appeal, the applicant provided an AF Form 901,
Reenlistment Eligibility Annex to DD Form 4, dated 4 January 2002 and an
Enlistment/Reenlistment Document of the Armed Forces of the United States,
dated 27 December 2001.

STATEMENT OF FACTS:
The applicant’s initial enlistment in the Regular Air Force was on 24 June
1994 in the grade of airman basic for a period of four (4) years.
The applicant reenlisted on 29 August 1997, in the grade of senior airman
for a period of four (4) years.
On 2 August 2001, the applicant requested an extension to his 29 August
1997 enlistment to complete the weight management program (WMP).
On 10 August 2001, his request was approved and his date of separation was
extended from 28 August 2001 to 28 December 2001.
The applicant contracted his last enlistment on 27 December 2001 for a
period of six (6) years in the grade of staff sergeant.

AIR FORCE EVALUATION:
AFPC/DPPAE recommended denial. They indicated that the applicant contends
the Military Personnel Flight (MPF) failed to provide counseling regarding
a pending SRB change. On 17 January 2002, HQ USAF released a new SRB list
and announced that affected personnel should be briefed. The window to get
the SRB recomputed was if a member reenlisted between 2 January 2002 and 16
January 2002. The SRB review had not been announced as of the date the
applicant reenlisted and therefore the MPF was not able to brief the
applicant it had changed.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 20 December 2002, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within thirty (30) days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or an injustice warranting a constructive
reenlistment to qualify for a Selective Reenlistment Bonus (SRB). The
applicant contends that the SRB was changed approximately 20 days after his
reenlistment; however, he believed the reenlistment bonus would not change
since the new fiscal year had started. The Board notes that on 29 August
1997, the applicant reenlisted for a period of four (4) years and on
2 August 2001, he extended his enlistment for a period of four (4) months
in order to complete the weight management program (WMP), thereby changing
his DOS from 28 August 2001 to 28 December 2001. Therefore, he had no
other choice but to reenlist on 27 December 2001 or leave active duty. As
a result, when the Air Force announced the new SRB on 17 January 2002, he
was ineligible to have his SRB recomputed because he had reenlisted before
2 January 2002. The Board is not persuaded that he has established that he
has been the victim of either an error or injustice. The window to get the
SRB recomputed was if a member reenlisted between 2 January 2002 and 16
January 2002. It is apparent that the applicant could not have elected to
reenlist within that window to receive the new SRB because the SRB review
had not been announced as of the date the applicant reenlisted and the MPF
was not able to brief the applicant it had changed. Therefore, in the
absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
