STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant's military records, are contained in the letter prepared by
the appropriate office of the Air Force (Exhibit C).

AIR FORCE EVALUATION:
AFPC/DPPAE recommended denial. They indicated that the applicant
reenlisted 1 January 2002 for 5 years and 4 months. On 17 January
2002, HQ USAF released a new Selective Reenlistment Bonus (SRB) list
that changed the SRB entitlement for his Air Force Specialty Code
(AFSC) from 1.5 to 4.0 and announced that affected personnel should be
briefed. The window to get the SRB recomputed was if member
reenlisted between 2 January 2002 and 16 January 2002. The SRB review
was not announced during the timeframe the applicant reenlisted;
therefore, the Military Personnel Flight (MPF) could not have briefed
him that an SRB review was taking place.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 10 May 2002, a copy of the evaluation was forwarded to the
applicant for review and response within thirty (30) days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice warranting his constructive
reenlistment date be changed from 1 January 2002 to 29 January 2002.
The applicant contends that if he had known that the SRB listing was
under review, he would have waited to reenlist after the review was
completed. He was informed that if the SRB decreased he would have
had 30 days after the change to reenlist. The Board notes that the
applicant enlisted on 30 July 1997 for a period of four (4) years,
with a date of separation (DOS) of 29 July 2001. On 16 March 1999, he
extended his enlistment for a period of 23 months in order to qualify
for an overseas assignment, thereby changing his DOS to 29 June 2003.
On 17 January 2002, HQ USAF released a new SRB list that changed the
SRB entitlement for the applicant’s AFSC from 1.5 to 4.0. The window
to get the SRB recomputed was if a member reenlisted between 2 January
2002 and 16 January 2002. The Board is of the opinion that the
applicant could have elected to reenlist within that window to receive
the new SRB. It is not clear why he enlisted on 1 January 2002. If
the applicant could provide evidence to the fact that he was
miscounseled to reenlist on the 1st, outside of the window, the Board
would reconsider reviewing his request again. Therefore, in the
absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of an error or an injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
