         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the orders awarding him the parachutist badge be removed from his Official Military Personnel File (OMPF).

3. The applicant states that he was medically dropped from the Airborne course and didn’t complete the training.

4. In support of his request, he submits a copy of the orders awarding him the Parachutist Badge on 19 November 1993, and a memorandum from the
US Army Infantry School which states that the applicant was released from the Basic Airborne Course, Class 5-94, conducted from 29 October to 19 November 1993, for medical reasons.

5. The applicant is currently serving on active duty in pay grade E-6.

CONCLUSIONS:

1. The memorandum from the US Army Infantry School confirms the applicant’s contention that he didn’t complete the Basic Airborne Course. As such, the orders awarding him the Parachutist Badge should never have been published.

2. While an erroneously issued order is normally revoked, the applicant has specifically asked for the order to be removed from his OMPF. The Board has carefully considered this deviation from the norm, and has determined that the removal of an order which obviously should never have been published would preclude any future confusion concerning whether the applicant is parachutist qualified.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by removing Permanent Orders 212-477, dated 9 November 1993, from the applicant’s OMPF.
