The Board considered the following evidence:

if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, removal of his orders for award of
the Parachutist Badge from his official military personnel file (OMPF).
2. The applicant states, in effect, that the award orders on his record
are inaccurate as he never completed his training due to an injury half-way
through. He was diagnosed with patellar femoral syndrome and was placed on
profile for 2 months. At the time he declined the option to retrain and
take orders to Fort Campbell, Kentucky. He had been trying to get the
airborne award orders taken off his OMPF since then, by working through the
S1 at every unit he has been assigned. He has taken this action in hopes
of his desired outcome as he does not want to be passed up for promotion
because he will not be wearing airborne wings in his Department of the Army
photograph. He also states that removal of these orders should be strongly
considered as it jeopardizes his future promotion opportunities and would
be against Army ethics to ever wear an award that he never earned.
3. The applicant further states that he has been trying to use the proper
command channel through his previous units he has been assigned. He has
been advised to provide a copy of the airborne award orders and they would
publish revocation orders on his OMPF. There has been no such action and
he feels somewhat pressured to take this course of action to eliminate any
confusion a promotion board member might have when reviewing his records.
He is eligible for the upcoming E-7 board and wants to make sure his
records are squared away.
4. The applicant provides copies of his orders for award of the
Parachutist Badge, his DA form 5181-R (Screening Note of Acute Medical
Care), and his Reverse of DA Form 5181-R (Record of Acute Medical Care), in
support of his request.
CONSIDERATION OF EVIDENCE:
1. The applicant's military records show he enlisted in the Delayed
Entry/Enlistment Program and was ordered to active duty on 23 January 1997.
2. His records show he was issued Permanent Orders Number 180-248, dated
25 June 1997, announcing award of the Parachutist Badge in military
occupational specialty 92G1P, for successful completion of airborne
training. The completion of his airborne training was not scheduled to end
until 11 July 1997.
3. The applicant submitted documentation that shows he received medical
treatment from 27 June through 1 July 1997 for lower back pain.
4. The applicant's records do not show he successfully completed airborne
training.
5. Army Regulation 600-8-22 (Military Awards), in pertinent part, sets
forth requirements for award of the basic Parachutist Badge. Award of the
basic Parachutist Badge requires that an individual must have
satisfactorily completed the prescribed proficiency tests while assigned or
attached to an airborne unit or the Airborne Department of the Infantry
School, or have participated in at least one combat parachute jump.
6. Army Regulation 600-8-22 also provides, in pertinent part, that
commanders authorized to award combat and special skill badges are
authorized to revoke such awards. Revocation of award of badges will be
announced in permanent orders. An award of any combat or special skill
badge will automatically be revoked on dismissal. The parachutist badge
may be revoked when the awardee initiates action which results in
termination of airborne status or withdrawal of any specialty skill
identified before he/she completed 36 cumulative months of airborne duty.
DISCUSSION AND CONCLUSIONS:
1. In view of the circumstances in this case, the applicant is entitled to
revocation and removal of Permanent Orders Number 180-248, dated 29 June
1997, from his OMPF.
2. The evidence of record does not show the applicant successfully
completed airborne training for award of the Parachutist Badge. Orders
awarding the applicant the Parachutist Badge were published in advance of
the scheduled end date of his airborne training. Therefore, in accordance
with pertinent regulations, revocation of this award should have been
automatic and it is not authorized to be filed in his OMPF.
3. In view of the foregoing, the applicant’s records should be corrected
as recommended below.

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
revoking and removing Permanent Orders Number 180-248, dated 29 June 1997,
from his official military personnel file.
