GENERAL: The applicant appeals for upgrade of discharge to honorable, and change of authori ty for the discharge and to change the reenl istment code.

The applicant was offered a personal appearance before the Discharge Review Board (OR B) but decl ined and requests that the review be completed based on the available service record.

The attached brief contains available perti nent data on the applicant and the factors leading to the discharge.

FIN DI NG: The Board denies the upgrade of the discharge, and change of authority for the discharge and to change the reenlistment code.


ISSUE: The appl icant received a General discharge for Misconduct - Minor Discipli nary Infractions

The Air Force Discharge Review Board, under i ts responsibility to examine the propriety and equity of an Applicant" s discharge, is authorized to change the characteri zation of service and the reason for discharge if such change is warranted . In reviewing discharges, the Board presumes regulari ty in the conduct of governmenta l affairs unless there is substantial cred i ble evidence to rebut the presumption , to include evidence submi tted by the appl icant. The Board com pleted a thorough review of the circu mstances that led to the discharge and the discharge process to ensure the discharge met the pe1iinent standard s of equity and propriety. The Appl icant's record of service i ncl uded one A rticle 15 for a DUI that resul ted in the injury to a SrA; one Letter of Admonishme nt for failing to go on tim e; and two Letter of Reprima nds for fa i l ing to go to duty on ti me and for being cited by civi l ian law enforcemen t for DU I with a BAC of . I 04.

The member contends that hi s d ischarge was unfai r due to propriety reason s. The member bel ieves that since he was charged and found guil ty in a civi l ian court for his 211 DU I that the Air Force should not have
d
included that DU I as part of the reason for hi s discharge. A discharge is upgraded onl y if the appl icant and the Board can establish that an i nequity or impropriety took place at the t ime of discha rge. After a thorough review of the record , the Board found no evidence to just i fy an upgrade of the discharge characterizat ion, reason for the discharge or the reenl istmcnt code.·

CONCLUS ION : The Discharge Revie1.v Board concluclcs that the discharge was consisten t with the proced ura l and substantive requi rements of the d ischarge regulation, was within the discretion of the discharge authority, and that the appl icant was provided full administrati ve due process.

I n view of the foregoing findi ngs, the Board further concludes that there exists no lega l or equitable basis for upgrade of discharge and dete1111ines the discharge should rema i n unchan ged.
