GENERAL : The applicant appeals for upgrade of discharge to Honorable.

The applicant was offered a persona l appearance before the Discharge Review Board (DRS) but declined and req uests that the review be completed based on the available service record.

The attached brief conta ins available pertinent data on the applicant and the factors leading to the discharge. FIN DING : The Board denies the upgrade of the discharge.
ISSUE: The appl icant received a General discharge for M isconduct - Drug Abuse

The Air Force Discharge Review Board, under i ts responsi bi lity to examine the propriety and equ ity of an Applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. In reviewing discharges, the Board presumes regu larity in the conduct of governmenta l affairs unless there is substantial credible evidence to rebut the presumpt ion, to incl ude evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the perti nent standards of equity and prop1iety. The Applicant's record of service included an A11icle 15 for usi ng spice.

The member contends that her discharge was inequi table because i t was based on one incident that happened in her I 03 month of service. The applicant stated that she only u ed spice to hel p rel ieve the stress from work and her personal l i fe. After a review of the records the Boa rd fou nd no evidence that the appl icant was unaware of t he Ai r Force·s zero tolerance policy on drug use. Drug abuse is incompatible with mil ita1y service and ai1men who abuse drugs one or more times are subject to discharge for misconduct. A discharge is upgraded only if the applicant and the Board can establish that an inequi ty or i mpropriety took place at the time of
discharge. A fter a thorough review of the records, the Board found no evidence to wa1Tant an upgrade of the disc,harge characteri zation.

CONCLUS ION: The Discharge Review Board concludes that the discharge was consistent with the proced ural and substan t ive req u irements of the discharge regu lation, was within the discretion of the discharge authority, and that the appl icant was provided full administrati ve due process.

I n view of the foregoi ng find ings, the Board further conclude that t here exists no legal or equitable basis for upgrade of discharge and determi nes the discharge should remai n unchanged.
